SO ABOUT, UM, AND IF YOU LOOK AT WHERE THE 2021 ASSESSMENT WAS, WAS AROUND 623 MILLION, JUST, UH, IN THE MATTER OF ONE, JUST A MATTER OF THE PAST YEAR, OUR ASSESSMENTS HAVE GONE DOWN ACROSS OUR 15 PROPERTIES, AROUND 66.1 MILLION.
SO THAT, THAT ACCOUNTED FOR, UH, MADE OUR, CERTAINLY MADE THE EFFORT AT GETTING A BALANCED BUDGET MORE DIFFICULT WITH, UH, NOT HAVING ANY INCREASE IN OUR, UH, TAX BASE.
AND THAT ALSO HAS A, HAS A RELATIONSHIP IN OUR EIT, WHICH ALSO, UH, IS REMAINING.
WE'RE EXPECTING TO REMAIN LEVEL.
SO, UM, IT WAS, UH, MORE DIFFICULT THIS YEAR IN TRYING TO BALANCE OUR BUDGET.

WE HAVE PENDING GRANTS, UH, THAT WE'RE AWAITING DECISIONS FROM THE, UH, FROM THE STATE, UH, TO THE TUNE OF AROUND 10, CLOSE TO $11 MILLION.
AND WE HAVE SOME UPCOMING GRANT DEADLINES THAT WE'RE GONNA BE ADDING $2 MILLION.
A LOT OF THESE GRANTS HAVE MATCHING FUNDS, WHICH HAVE BEEN, UM, IDENTIFIED IN THE, IN THE BUDGET.
UM, JUST WANNA TALK A LITTLE BIT ABOUT THE, UH, THE LEVY COMPARISON.
UM, THIS IS WHAT SIMILAR TABLE WE HAD LAST YEAR AS FAR AS WHAT THE REAL ESTATE, UH, IMPACT WILL BE.
WE'RE NOT, WE'RE NOT PROPOSING ANY CHANGES IN THE REAL ESTATE TAX LEVY, EVEN THOUGH WE'RE EXPECTING SOME SLIGHT REDUCTIONS IN WHAT THOSE, UM, AND WHAT THE ASSESSMENTS WILL GENERATE.

UH, THE DEVELOPER'S AGREEMENT STATES THAT AT THE END OF THE PROJECT AND AFTER ALL THE, THE, YOU KNOW, THE MAINTENANCE BOND AND EVERYTHING HAS BEEN, HAS BEEN, THE TIME HAS BEEN USED UP, UH, THE DEVELOPER, THE DEVELOPER, THE OWNER OF THE PROPERTY CAN COME TO THE TOWNSHIP AND ASK THEM TO ESSENTIALLY OFF EXECUTE A DOCUMENT THAT GETS RECORDED AGAINST THE PROPERTY.

OKAY, THIS IS A SETTLEMENT STIPULATION.
THIS WAS A TAX ASSESSMENT APPEAL, UH, WHERE THE CURRENT ASSESSMENT VALUE IS 6.4 MILLION.
UH, THERE WAS A, UH, APPEAL OF THAT ASSESSMENT.
THE SCHOOL DISTRICT ACTIVELY PARTICIPATED IN THAT APPEAL.
UH, THEY'VE NOW REACHED THE SETTLEMENT AGREEMENT WHEREBY THE, UH, 20 25, 26 TAX YEAR WILL BE REDUCED TO APPROXIMATELY 4.3 MILLION AND THEN 20 26, 27 AND ONWARD WOULD BE REDUCED TO 4.045 MILLION.
UM, WE WOULD HAVE TO REFUND OVERPAYMENT OF, OF THOSE FUNDS, UH, TO THE EXTENT THAT THEY OVERPAY TO THE TOWNSHIP.
TYPICALLY, AS I'M SURE YOU'RE ALL ARE AWARE, THESE UH, APPEALS ARE USUALLY, UH, MORE INTENSELY LITIGATED BY THE SCHOOL DISTRICT JUST BECAUSE THEY HAVE MORE MONEY AT STAKE IN RELATION TO THE, THE PROJECTS.
UH, IN MY CONVERSATIONS WITH THE, THE, UH, SOLICITOR FOR THE SCHOOL BOARD, UM, OR THE SCHOOL DISTRICT, UM, YOU KNOW, I, I THINK THIS IS A REASONABLE SETTLEMENT.
SO JUST LOOKING FOR AUTHORIZATION TO, UH, EXECUTE THAT SETTLEMENT AGREEMENT.

THERE ACTUALLY WAS A TENANT PLAN THAT WAS APPROVED BY THE BOARD RELATED TO A TOWNHOUSE DEVELOPMENT IN THAT PROJECT.
UM, BASED ON THE TERMS OF THE LEASE, WE'VE BEEN NEGOTIATING WITH THE DEVELOPER, UH, AS TO AN AMENDMENT TO THE LEASE BECAUSE TECHNICALLY THAT LEASE COULD HAVE STOPPED THE DEVELOPMENT THAT THEY WERE LOOKING TO DO THERE, AT LEAST THE, THE NUMBER OF UNITS THEY WERE LOOKING AT BASED ON THE, THE REQUIRED OPEN SPACE.
SO IN YOUR PACKET, UM, I'VE INCLUDED A DRAFT MEMORANDUM OF AGREEMENT.
UH, THIS IS REALLY JUST KIND OF SETTING OUT THE TERMS THAT WE HAVE REACHED WITH THE DEVELOPER AT THIS POINT.
