AS A, AS AN INTERESTED AND ENGAGED CITIZEN, I LOOK FORWARD, UH, TO WORKING WITH YOU ALL.

UH, DURING OUR LAST FOUR TO SUPERVISORS MEETING, THE PARKHOUSE FRIENDS GROUP SHARED A SUMMARY COMPARISON DOCUMENT BETWEEN THE CURRENT OPEN SPACE RESIDENTIAL COMMUNITY TWO ZONING ORDINANCE, AND THE PROPOSED ORDINANCE AMENDMENT THAT WAS HANDED OUT AT THE NOVEMBER 20TH BOARD MEETING.

SO WE HOPE THE BOARD WILL USE THAT COMPARISON DOCUMENT TO PERFORM A CRITICAL REVIEW OF THE PROPOSED AMENDMENT SEPARATELY.

I SENT AN EMAIL ON DECEMBER 13TH TO THE SUPERVISORS, UH, ENCOURAGING THEM TO SEEK AN INDEPENDENT LEGAL REVIEW OF THE PROPOSED AMENDMENT BEFORE CONSIDERING IT AT THE UPCOMING JANUARY 16TH BOARD MEETING.

WHY? BECAUSE THERE ARE FUNDAMENTAL QUESTIONS THAT SHOULD BE ADDRESSED BEFORE THE BOARD CONSIDERS THAT PROPOSED AMENDMENT FUNDAMENTAL QUESTIONS.

FOR INSTANCE, UH, WHY IS THIS PROPOSED AMENDMENT TO OPEN SPACE RESIDENTIAL TWO, WHEN THE PROPOSED DENSITY IS NOT EVEN CLOSE TO R TWO? IN FACT, THE PROPOSED DENSITY IS MUCH HIGHER BETWEEN R THREE AND R FOUR.

SO CALLING IT AN AMENDMENT TO OPEN SPACE RESIDENTIAL TWO SEEMS LIKE A MISREPRESENTATION TO ME, BUT THERE ARE MANY MORE QUESTIONS AND POTENTIAL LEGAL DISCREPANCIES IN THAT DOCUMENT, SOME OF WHICH YOU MAY SEE IN THAT COMPARISON DOCUMENT THAT I MENTIONED.

SO MY BOTTOM LINE IS, IS THE PROPOSED ZONING ORDINANCE AMENDMENT READY FOR CONSIDERATION BY THE BOARD ON JANUARY 16TH.

AND I, I HAVE A, A SEPARATE POINT I'D LIKE TO RAISE, UM, THROUGH A RIGHT TO KNOW REQUEST RESPONSE THAT WE RECEIVED RECENTLY.

UH, WE LEARNED THAT, UH, THE SOLICITOR, UH, HAS ENGAGED IN SETTLEMENT DISCUSSIONS WITH COUNSEL FOR LAWYERS FOR HOLDINGS, THE APPLICANT FOR THE, YOU KNOW, THIS POTENTIAL REZONING CONDITIONAL USE, WHATEVER THAT IS PLAYING OUT TO BE.

YOU KNOW, THEY, THE, THE SOLICITOR HAS ENGAGED IN SETTLEMENT DISCUSSIONS WITH COUNSEL FOR THAT APPLICANT.

THAT'S MR. MULLEN TO POTENTIALLY REZONE THE PROPERTY TO ALLOW FEWER UNITS THAN SET FORTH IN THE CONDITIONAL USE APPLICATION AND LIFTING THE SENIOR HOUSING REQUIREMENT.

NOW, I, I WANNA RAISE JUST A FEW POINTS.

YOU KNOW, FIRST OF ALL, THAT CONDITIONAL USE APPLICATION WAS FOR

1200 AND A FEW UNITS, BUT THE INFORMATION WAS VERY LIMITED.

SO CAN WE REASONABLY SAY THAT W WAS IT PRACTICAL TO BUILD 1200 UNITS ON THE PROPERTY CONSIDERING THAT THE INFORMATION WAS SO LIMITED IN SKETCHING? AND THEN, YOU KNOW, AS WE, AS WE LOOK AT OTHER ASSUMPTIONS THAT WE'RE MAKING RELATIVE TO THE NUMBER OF UNITS, RELATIVE TO OTHER ASPECTS, UM, FOR THIS, THIS PROPOSAL, ARE WE REALLY CRITICALLY EXAMINING WHETHER AND, AND THIS ASSOCIATED ORDINANCE AMENDMENT IS IN THE BEST INTEREST OF THE CITIZENS OF THIS TOWNSHIP? MY ANSWER IS NO.

UH, YOU KNOW, THE, THE PROPERTY KNOWN AS COUNTRY RIDGE, UH, WAS ZONED R ONE, AND IT WAS DEVELOPED AS R ONE.

UH, THE, THE DEVELOPMENT KNOWN AS, UH, WILLOWBROOK WAS ZONED R ONE AND WAS DEVELOPED AS R ONE PROVIDENCE HUNT, RIGHT OVER HERE, DOWN THE STREET R ONE, AND WAS DEVELOPED THAT WAY.

AND THE TWO DEVELOPMENTS OVER ON, UH, DRIVE OF THIS ROAD, SAME THING, R ONE.

AND THAT'S WHAT THEY WERE DEVELOPED AS.

UH, AND NOW WE HAVE, YOU KNOW, A DEVELOPER COMING FORWARD ASKING TO DEVELOP THIS PROPERTY BEYOND R ONE AND IT'S ZONE OPEN SPACE, YOU KNOW, AND I WOULD ENCOURAGE THE SUPERVISORS, AND IT'S, IT'S BEEN DOCUMENTED WHEN THIS PROPERTY WAS TRANSFERRED, THE MONTGOMERY COUNTY SOLICITOR SAID, IT'S UP TO THE SUPERVISORS OF UPPER PROVIDENCE TOWNSHIP AS TO WHAT'S GONNA HAPPEN TO THIS PROPERTY.

AND I WOULD, YOU KNOW, OF COURSE, REALLY LIKE TO ENCOURAGE YOU GUYS TO, LET'S, LET'S STICK WITH THAT.

AND IF WE NEED REPRESENTATION, WHO IS PART OF AN OPEN SPACE ADVOCACY, WHO CAN WORK WITH US AND HELP US TO GET THIS TO BE OPEN SPACE, I THINK THAT'S THE BEST THING FOR THE TOWNSHIP AND FOR THE CITIZENS OF THIS COMMUNITY.

I'M GLAD THAT WE HAVE TWO NEW FACES ON THE, THE BOARD AND, UH, LOOK FORWARD TO WORKING WITH YOU.

UH, I WANTED TO JUST POINT OUT SOME THINGS ON THE, I'M HERE TO TALK ABOUT PARKHOUSE AND I WANTED TO POINT OUT SOME THINGS THAT, UH, MIGHT HAVE BEEN OVERLOOKED.

AND THAT IS THAT NATURAL LANDS DID A REPORT, AND IT WAS VERY EXTENSIVE.

IN FACT, WE, WE ASKED THEM TO DO THE REPORT AND WE ALSO ASKED THEM TO PRIORITIZE IT, WHICH I FEEL WAS SOMEWHAT BIASED BECAUSE THEIR TRUE TAKEAWAY WAS THAT ALL OF THIS LAND SHOULD BE CONSERVED BECAUSE IT'S SUCH A VITAL PART OF THE SCHUELL RIVER CORRIDOR AND ALSO THE HERITAGE OF THE PORT PROVIDENCE HERITAGE AREA.

AND SO I HAVE THE LATEST PLAN FROM OUR DEVELOPMENT DEVELOPERS, AND I WANTED TO JUST SHOW YOU THE COMPARISON BECAUSE IT'S IMPORTANT TO NOTE THAT NATURAL LANDS SAID THAT, HEY, WE PRIORITIZED IT A, B, AND C FOR, WE PRIORITIZED THE HIGHEST TO LOWEST.

BUT THEY POINTED OUT THAT THE LOWEST, THE LEAST PRIORITIZED AREA IS IN FACT THE MOST CONNECTED TO THE HIGHEST PRIORITY AREA.

SO I JUST WANNA SHOW YOU WHAT THIS, THIS IS NATURAL LAND, AND

THEY'RE SAYING THAT ALL OF THIS AREA IS ONE AND TWO, AND WHERE IT'S DARK GREEN, THAT IS HIGHEST.

AND WHERE YOU HAVE THIS A DOWN HERE, WHICH IS, UH, WHERE THE MULTIPLE 48 FOOT TOWNHOUSES ARE ASLEEP, IS DIRECTLY CONNECTED TO THE GREEN AREAS.

AND THAT THIS HAS, HAS WATER RUNOFF.

IT IS VERY CONNECTED WHERE THESE CIRCLES ARE, THIS IS SEEP SEEPAGE.

SO THERE'S WATER UNDERNEATH.

UM, AND IT'S, IT'S HIGHLY, UM, WATER PRONE.

SO PLEASE THINK ABOUT THIS AS A MORE HOLISTICALLY THAN, THAN, UH, HEY, WE CAN REZONE THIS AND WORK THAT WAY.

THERE MIGHT BE OTHER WAYS AS TO BUILD WHAT HE'S PROPOSING.

LOOK AT OP BUILDING IN OTHER WAYS OF PAYING FOR THE LAND.

OKAY, AS A CONCERNED CITIZEN AND RESIDENT, OUR UPPER PROVIDENCE TOWNSHIP, MONTGOMERY COUNTY, I WANT TO LET IT BE KNOWN THAT THE PROPOSED ZONING AMENDMENT RELATED TO THE PARKHOUSE PROPERTY AND THE A COPYING PROPOSED PARKHOUSE DEVELOPMENT, UH, SKETCH AND PLUGIN, UH, IS I AM ADAMANTLY AND STRONGLY OPPOSED TO ANY CHANGES TO THE ORDINANCE FOR THIS PROPERTY.

THERE'S ABSOLUTELY NO COMPELLING REASON TO CHANGE THE CURRENT ZONING CLASSIFICATION OF OPEN SPACE DISTRICT WITH THE INSTITUTIONAL OVERLAY.

THERE'S ALSO NO COMPELLING REASON TO AMEND THE OPEN SPACE RESIDENTIAL, UH, COMMUNITY R TWO ORDINANCE.

UM, UNLESS I'M MISSING SOMETHING, THERE SEEMS TO BE A TWO STEP PROCESS HERE.

UM, FIRST STEP IS TO AMEND THE OS TWO, UH, OSS R DASH TWO ORDINANCE TO MAKE HIGH DENSITY, UH, HOUSING ALLOWED, AND THEN TO CHANGE THE, UH, OSR, UH, TO ORDINANCE, UH, TO, TO BE ZONED, UH, UH, TO CHANGE THE PARK HOUSE PROPERTY TO BE ZONED TO THAT, UM, OSR DASH TWO.

SO THIS SEEMS LIKE A VERY CONVOLUTED WAY TO ALLOW DEVELOPMENT OF A PARCEL THAT THE COUNTY WEBSITE IS STILL ONLY SHOWS BEING VALUED AT, UM, FOUR, 4 MILLION.

SO ALSO, DESPITE THE LAND BEING PRIVATELY HELD AT THE TIME OF PURCH, UH, PURCHASE, ALL OWNERS KNEW HOW THE LAND WAS ZONED.

YOU DON'T BUY PROPERTY EXPECTING THE TOWNSHIP TO CHANGE THE ZONING.

THAT IS THE WAY, THAT IS WAY TOO RISKY.

ONE OF THE EARLY OWNERS, IN FACT, SCOTT RIF RIFKIN, HOWEVER, WAS FINE WITH THE ZONING.

IN A MARCH, UM, 2014 ON GOAL IN THE PENNSYLVANIA, UM, INQUIRE, HE STATED THAT THE LAND RESTRICTIONS PUT IN PLACE.

WE ARE FINE WITH

WE HAVE SAID FROM THE BEGINNING THAT WE ARE NOT LAND DEVELOPERS.

SO YOUR OWN WEBSITE SAYS THAT THE INTENT OF THIS ZONING, THIS LAND AS OSC WITH, UH, UM, INSTITUTIONAL OVERLAY IS TO PROTECT THE LAND, PROTECT IT FROM NEGATIVE IMPACTS OF SUBURBANIZATION IS SMALL AND INAPPROPRIATE USE AND PROTECTIVE EXISTING VISTAS RAW, UM, CHARACTER AND UNIQUE LAND FORMS. UM, UPPER PROVIDENCE TOWNSHIP PROVIDES MORE THAN AN ADEQUATE AMOUNT OF HIGH DENSITY HOUSING IN THE PARTS OF THE TOWNSHIP WHERE THAT USE IS APPROPRIATE.

IN CONTRAST, THE PARKHOUSE PROPERTY IS IDENTIFIED IN THE MONTGOMERY COUNTY 2040 SHARED VISIT PLAN AS A CONSERVATIVE AREA OPPORTUNITY AREA, CITING THESE ENVIRONMENTALLY SENSITIVE AREAS.

AND GREENWAYS SHOULD HAVE MINIMAL DEVELOPMENT, IF ANY.

SO, IF THE, IF THE DEVELOPMENT WERE TO PROCEED, THERE ARE NUMEROUS NEGATIVE IMPLICATIONS, SUCH AS INCREASE.

AND WE, WE TALKED, UH, THE PRIOR COMMENTERS, UH, TALKED ABOUT THIS, THAT, UH, YOU KNOW, INCREASED AND OVERWHELMING TRAFFIC DEMANDS ON POLICE, FIRE AND EMS SERVICES.

NEGATIVE IMPACTS HERE ALREADY OVERPOPULATED AND STRAINED, UH, SPRING FOR SCHOOL DISTRICT ENVIRONMENTAL AND AGRICULTURAL DAMAGE, INCREASING THE LIKELIHOOD OF FLOODING.

JUST TO NAME A FEW, A FEW.

UM, MOST OF ALL THIS WILL CERTAINLY INCREASE OUR TAXES AND NEGATIVE NEGATIVELY IMPACT OUR COMMUNITY, AGAIN, IS ZONING.

ANY CHANGE BEING PROPOSED IN THE AMENDMENT WOULD HAVE NO POSITIVE OUTCOME FOR THE TOWNSHIP, THE RESIDENTS OR THE SURROUNDING COMMUNITIES.

ZONING RESTRICTIONS ARE THERE FOR A REASON.

WE ALL MUST COMPLY WITH THESE RESTRICTIONS, AND IT'S AGAINST PENNSYLVANIA LAW TO THINK OTHERWISE.

I ASKED YOU TO NOT PERMIT THIS PLAN TO PROCEED FORWARD TO THE TOWNSHIP PLANNING COMMISSION AS A TAX PAYING RESIDENT OF UPPER PROVIDENCE TOWNSHIP.
