ANOTHER PIECE THAT JOHN DID WAS GET THE BOARD EXPANDED TO FIVE MEMBERS WHEN THE POPULATION OF TOWNSHIP GREW TO WHERE WE NEEDED FIVE MEMBERS.

I FEEL LIKE A LOT OF NIGHTS WE NEED MORE THAN FIVE BRAINS TO FIGURE OUT SOME OF THE PROBLEMS. BUT, UH, ANYWAY, I JUST WANT TO, I I, I WANTED TO SAY A SPECIAL WORD ABOUT JOHN AND I THINK HE'S THE LAST, YOU'RE A NATIVE OF UPPER PROVIDENCE, RIGHT? BORN AND RAISED HERE.

WELL, BORN IN CONSHOHOCKEN.

CON'S BEEN HERE FOR YEARS.

JOHN'S BEEN A BUSINESS OWNER IN TOWNSHIP AND LIVED HERE A VERY LONG TIME.

UM, BUT I'M ACTUALLY HERE TO TALK ABOUT THE PARK HOUSE, UH, UH, UH, RECOMMENDATIONS FOR PROPOSED AMENDMENT OF THE CURRENT ZONING ORDINANCE.

LAST, UH, MONTH'S MEETING, OBVIOUSLY THERE WAS IMPORTANT, THERE WAS SOME INFORMATION THAT WAS HANDED OUT AT THE LATTER PART OF THE MEETING.

UM, IT WASN'T REALLY, UH, QUITE INFORMATIONAL TO ALL OF US, AND I BELIEVE THAT IT WILL BECOME INFORMATIONAL TO US IN THE FUTURE.

UM, THERE ARE A LOT OF THINGS THAT ARE VERY, UH, SIGNIFICANT ABOUT THIS CURRENT, UH, UH, ORDINANCE AND THE, THE PROPOSED AMENDMENT THAT ARE STAGGERING DIFFERENCES THAT WOULD CHANGE THE ENTIRE TOWNSHIP.

NOT JUST ONE TRACK OF LAND, BUT IT'S BEING WRITTEN FOR ONE TRACK OF LAND BY A DEVELOPER.

AND WE'VE RECOGNIZE THAT IT'S BEING WRITTEN BY A DEVELOPER FOR YOU AS THE TOWNSHIP'S SUPERVISORS TO CONSIDER.

SO ONE OF THE THINGS THAT WE JUST WANT TO, AND SOME OF THE MEMBERS OF THE COMMITTEE WILL BE TALKING ABOUT THIS IN A MOMENT, BUT AGAIN, THE, THE ASSESSMENT, THE KEY POINTS ARE REALLY SIGNIFICANT OF THE DIFFERENCES.

UM, SO I THINK WE WANT TO MAKE SURE THAT PEOPLE ARE AWARE THERE ARE SIGNIFICANT CHANGES IN THIS.

UM, THE OTHER THING THAT I THINK THAT IS REALLY IMPORTANT FOR US IS THAT YOU AS SUPERVISORS RAN ON A PLATFORM.

UM, WE WANNA, WE ELECTED YOU ON THAT PLATFORM FOR GIVEN REASONS THAT YOU ARE GOING TO HAVE THE BEST INTEREST OF THIS ENTIRE TOWNSHIP AND THE COMMUNITIES INVOLVED HERE.

UM, IT'S, WE FEEL THAT IT'S YOUR COMMITMENT TO THAT, THAT, UH, PLATFORM THAT WE DON'T WANNA SEE YOUR BREACH, YOUR COMMITMENT.

UM, SO AGAIN, CHANGES TO THIS AS ZONING.

WOULD FOR MANY OF YOU BE A CHANGE IN WHAT YOU HAD PROMISED.

UM, WE ALSO RECOGNIZE THAT CHANGES TO THIS CURRENT ZONING AS IT WOULD BE WRITTEN FOR SPECIFICALLY A TRACK OF LAND, EVEN THOUGH IT WILL IMPACT THE ENTIRE TOWNSHIP.

THAT IS AN, THAT IS A LEGAL RISK THAT YOU'RE TAKING, WHICH IS CALLED SPOT ZONING.

AND, YOU KNOW, I'M NOT AN ATTORNEY.

ATTORNEYS CAN RESEARCH THIS, BUT THE COMMONWEALTH, UH, COURT OF PENNSYLVANIA HAS CLEARLY TURNED DOWN SPOT ZONING.

AND, AND THIS RECOGNIZES THAT THIS IS BEING WRITTEN IN ACCORDANCE TO BASICALLY SINGLING OUT ONE LOT OR SMALL AREA FOR DIFFERENT TREATMENT THAT FROM THE ACCORDED TO SIMILAR SURROUNDING LAND, UH, AND REALLY FOR THE ECONOMIC BENEFIT OF THE OWNER, THAT IS SPOT ZONING.

SO BE AWARE THAT THAT IS A RISK THAT THE SUPERVISORS, THE BOARD, THE TOWNSHIP WOULD BE TAKING.

I'LL REITERATE THAT TODAY, BUT I'D REALLY LIKE TO FOCUS YOUR ATTENTION ON THE PROPOSED ZONING ORDINANCE AMENDMENT FOR OPEN SPACE RESIDENTIAL TWO O OSR TWO.

I READ THAT AFTER IT WAS HANDED OUT.

HOW DOES THIS SERVE THE CITIZENS OF THIS TOWNSHIP? WHY WOULD SUCH A WOEFULLY INADEQUATE DOCUMENT SO VASTLY DIFFERENT FROM THE EXISTING OSR TWO BE SUBMITTED TO YOU ALL FOR A REVIEW? WHY DID THIS DOCUMENT GET SCREENED BEFORE IT CAME UP FOR YOUR REVIEW? I WON'T POINT OUT ALL THE FLAWS THAT EXIST IN THAT DOCUMENT.

A SEPARATE ATTORNEY EXPERIENCED IN LAND DEVELOPMENT MATTERS SHOULD IDENTIFY THEM FOR YOU.

BUT I WILL HIGHLIGHT THE POTENTIAL IMPACTS ON OUR COMMUNITY.

FIRST, THAT AMENDMENT, UNLIKE THE CURRENT OSR TWO, WOULD ALLOW A HIGH DENSITY CLUSTER DEVELOPMENT ALMOST ANYWHERE IN THE TOWNSHIP SUBJECT TO CERTAIN CONDITIONS.

REGARDLESS OF THE CURRENT ZONING, THE AMENDMENT WOULD BYPASS THE ZONING HEARING BOARD PROCESS AND WOULD BYPASS THE CONDITIONAL USE HEARING PROCESS.

THE BOROUGH OF PHOENIXVILLE RECENTLY CHANGED AN ORDINANCE SPECIFICALLY GEARED TOWARDS THE CASE CENTER SALE.

THEY CHANGED AN ORDINANCE THAT WAS STATED AS SEVEN ACRES FOR HIGH DENSITY HOUSING.

THEY CHANGED IT TO 10.

THE CASE CENTER WAS 7.4 ACRES, WHICH TOLL BROTHERS THEN PUT HIGH DENSITY HOUSING ON THE PROPERTY.

THE BOROUGH CHANGED THAT ORDINANCE RESULTING IN EXTENSIVE LEGAL RAMIFICATIONS FOR THE TAXPAYERS BECAUSE THE TAXPAYERS ARE THE ONES THAT FUND THE BOROUGH.

NOW, TOLL BROTHERS IS SUING THE SCHOOL.

THE SCHOOL IS SUING THE BOROUGH.

TOLL BROTHERS ALSO SUING THE BOROUGH.

THESE ORDINANCE CHANGES THAT ARE PROPOSED HERE ARE GONNA BE VERY DETRIMENTAL TO THE FUTURE OF MY PROPERTY VALUE, AS WELL AS THE 36 OTHER HOMES IN MY PROP IN MY DEVELOPMENT AND THE NEXT 400 HOMES THAT ARE IN THE IMMEDIATE IMPACT OF THIS PROPERTY.

BUT THE IMPACT STUDY IS GONNA BE WAIVED.

NOW WHY IS THAT? I'VE PERSONALLY PULLED OVER A DOZEN CARS OUTTA THE DITCHES OF YEAGER SECOND AVENUE AND BLACKROCK ROAD.

'CAUSE THERE'S NO SHOULDER.

THERE'S ALSO NO STORM WATER MANAGEMENT.

WHERE'S ALL THAT WATER RUNOFF GOING DOWN THE SIDES OF THE STREETS.

VERY FREQUENTLY FLOODING THE STREETS.

BUT BEING A STATE ROUTE, I UNDERSTAND YOU GUYS HAVE RESTRICTIONS YOURSELVES TO MAKING ANY MODIFICATIONS THEREAFTER.
