I'D LIKE TO CALL TO ORDER THIS MEETING OF THE UPPER PROVIDENCE BOARD OF SUPERVISORS MONDAY, APRIL 19TH, 2021.

UH, THE POSITIVITY RATE IN THE COUNTY HAS SURGE BACK UP TO OVER 8% AT THIS TIME.

I KNOW THAT WE'RE VERY CLOSE TO WHIPPING THIS THROUGH VACCINATIONS, BUT VACCINATIONS WERE JUST OPENED UP TO ALL, UH, PERSONS 16 AND OLDER, AND I ENCOURAGE EVERYBODY TO GET ONE.

OUR SYMPATHIES GO OUT TO THE TOWNSHIP STAFF IN LOWER PROVIDENCE.

THEY HAD A MAJOR OUTBREAK IN THEIR TOWNSHIP STAFF THAT RESULTED IN TWO HOSPITALIZATIONS AND ONE DEATH.

SO ANYWAY, THAT'S MY RECOMMENDATION FOR THE NEXT MEETING.

THE FIRST FROM THE REPRESENTATIVE IS WE WILL NOT OCCUPY BUILDING 12 UNTIL ALL THE ROAD IMPROVEMENTS ARE DONE.

THE SECOND STATEMENT, THE ROADS WILL BE COMPLETED BEFORE WE OCCUPY THE BUILDING.

SO, AS NEIGHBORS HAVE EXPERIENCED MANY TIMES OVER THE COURSE OF THE LAST FEW YEARS, THE ASSURANCES THAT WE HEAR REGARDING S E I NEVER SEEM TO MATERIALIZE WHEN PUSH COMES TO SHOVE AND THE TOWNSHIP PACES, THE PROSPECT UPHOLDING DEVELOPERS FEET TO THE FIRE.

NOW, MAYBE THERE'S A LEGITIMATE REASON FOR THIS REQUEST, AND IF SO, WE'D LOVE TO HEAR IT.

ALSO, IF THE SUPERVISORS MOVE FORWARD WITH THE APPROVING THE RESOLUTION TYPE, THEN WE'D ASK EACH OF YOU TO PLEASE EXPLAIN FOR THE PUBLIC BEFORE YOU VOTE WHY YOU WOULD TAKE THIS ACTION.

I AM, UM, SPEAKING REGARDING, I BELIEVE IT'S, UM, AGENDA ITEM 13 REGARDING 3 95 GREENWOOD AVENUE, THE STAIR LU TRACT.

UM, I AND ONE OF THE NEIGHBORS THAT HAS BEEN VOICING CONCERNS ALONG WITH SEVERAL OF MY OTHER NEIGHBORS ABOUT THE DEVELOPMENT ON 3 95 GREENWOOD AVENUE DUE TO THE ILLEGAL DUMPING THAT OCCURRED IN THE LATE EIGHTIES.

UM, THE PROPERTY 3 95 GREENWOOD IS ON THE AGENDA FOR PRELIMINARY APPROVAL TONIGHT.

UM, AS YOU MAY KNOW, MY NEIGHBORS AND I HAVE BEEN CONCERNED ABOUT DEVELOPMENT ON THIS PROPERTY DUE TO THE POOR QUALITY OF THE PHASE ONE REPORT, UM, THAT TOOK PLACE, UM, THAT WAS PERFORMED BY, UM, THE ENGINEERING FIRM AND SUBMITTED BY THE BUILDER AND THE LACK OF TRANSPARENCY BY THE LAW FIRM HAMBURG, RUBEN MULLEN, AND MAXWELL, THAT, UM, CURRENTLY REPRESENTS THE BUILDER, BUT ALSO REPRESENTED MR. STEERLY, WHO WAS PERFORMING THE ILLEGAL DUMPING IN THE LATE EIGHTIES.

UM, I DO GREATLY APPRECIATE THE DECISION OF THE TOWNSHIP TO PURSUE THE PHASE TWO STUDY OF THE PROPERTY.

UM, THE PHASE TWO REPORT WAS COMPLETED, UM, HOWEVER, IT WAS PERFORMED BY THE SAME FIRM THAT COMPLETED THE PHASE ONE REPORT THAT, UM, WAS DONE VERY POORLY.

UM, THERE WERE SIGNIFICANT GAPS IN THE REPORT THAT, UM, WERE DETAILED, UM, IN A DOCUMENT THAT I SUBMITTED, UM, ALONG WITH MY NEIGHBORS.

UM, SO I HOPE THAT THE TOWNSHIP ENGINEERS HAVE PERFORMED THEIR DUE DILIGENCE TO ENSURE THAT THE FINDINGS OF THE REPORT WERE MORE COMPLETE THAN, UM, AND WERE ACTUALLY REPRESENTATIVE OF THE FINDINGS THERE ON THE PROPERTY.

UM, BASED ON THE FACT THAT IT WAS THE SAME BUILDER, I'M SORRY, THE SAME FIRM THAT COMPLETE THE PHASE ONE REPORT THAT WAS DONE SO POORLY.

UM, I ALSO WOULD LIKE TO ENSURE THAT, UM, BECAUSE OF, UH, THE LACK OF, UM, TRANSPARENCY, UM, AND THE POOR QUALITY OF THAT REPORT THAT WAS SUBMITTED, THAT THE TOWNSHIP WILL CONTINUE TO, UM, TAKE EXTRA PRECAUTIONS WHEN REVIEWING REPORTS FROM THIS FIRM, UM, TO ENSURE THAT THERE ARE NO GAPS, UM, IN THE, IN THE FINDINGS, AND THAT THERE SHOULDN'T BE FURTHER, UM, WORK PERFORMED, UM, TO ENSURE THE SAFETY OF THE, UM, RESIDENTS OF OUR COMMUNITY.

SO IF YOU WERE TO AWARD TO THIS PARTICULAR, UM, LOW BIDDER HIGHWAY MATERIALS, WHICH WHICH WE ARE RECOMMENDING, THE NET COST WOULD BE ABOUT 153,000 IN TERMS OF CONSTRUCTION COSTS.

I, MYSELF HAVE NOT, BUT, UH, WE HAVE, UM, IN ADDITION TO THIS COST, UH, THAT YOU DID, UH, BUY THE CULVERT SEPARATELY, UH, UNDER COSTARS, AND THAT PURCHASE PRICE WAS ABOUT $70,600 I BELIEVE.

SO OVERALL YOU HAVE A $286,000 PROJECT HERE.

BILL, COULD YOU GO OVER, CUZ I KNOW IT WAS SO MUCH MORE BEFORE AND I THINK WE RE-ENGINEERED IT AND CONFIGURED IT TO GET IT TO THIS LOWER COST, CORRECT? YES,

EARLY SEPTEMBER IS BEFORE THEY COULD COME IN AND PAY COOL ASHE PE NOW THEY'LL BE IN THERE PROBABLY MILLING AND DOING THE BASE REPAIRS BEFORE THAT TIME, BUT THE SURFACE COAT WOULD NOT GO DOWN UNTIL AFTER THE CULVERT'S COMPLETE.

UM, THE HOUSE IS VERY OLD.

IT DATES FROM 1750, AND I THINK THAT SPEAKS TO THE, TO THE LACK OF, UH, BIDDERS THAT WE RECEIVED ON THIS PROJECT.

UM, THERE WAS A MANDATORY MANDATORY PRE-BID CONSTRU PRE-CONSTRUCTION BID MEETING, UM, AND WE ONLY HAD ABOUT SIX OR SEVEN CONTRACTORS THERE.

SO, UM, TO HAVE RECEIVED TWO BIDS, CONSIDER US FORTUNATE IN THAT REGARD.

UM, ONE OF THEM TO WILSON, AS YOU INDICATED, CAME IN AT $244,300.

THAT'S UNDER THE, UM, BUDGETED EXPENDITURE THAT'S APPROVED IN THE BUDGET AT $250,000.

UH, CHRIS HOLLER FROM DEWEY ENGINEERING REVIEWED THEIR SUBMITTALS AND DOCUMENTS, AND HE'S PROVIDED US WITH A RECOMMENDATION, UH, LETTER RECOMMENDING AWARD OF THE BID TO WOL CONSTRUCTION.

WHY DO YOU THINK THEY'RE NERVOUS TO WORK ON STRUCTURE THAT OLD OR IS THAT WHY, UH, ONE, ONE OF THE OPEN ISSUES IN THERE WE'RE, WE'RE DOING WORK ON MANY OF THE WINDOWS OF THE 25 WINDOWS IN THE HOUSE, AND ONE OF THE REQUIREMENTS IS TO RESTORE THE INTERIOR FINISHES TO THE, YOU KNOW, OH, OKAY.

PRE, PRE-WORK CONDITION, UM, WITH PLASTER WALLS.

WE DETERMINED A STUDY THAT WE WOULD PROPOSE TO DO AND WE RAN IT PAST THE TOWNSHIP ENGINEER AND IN FACT, THE TOWNSHIP ENGINEER WAS PRESENT WHEN WE DID THE TEST.

WE DID TEST BOARDS, WE COME UNCOVERED DIFFERENT THINGS AND WE TOOK THOSE THINGS AND DID SOIL AND WATER SAMPLES AND DETERMINED THAT THERE IS NOTHING THERE WHICH BE AN ENVIRONMENTAL IMPACT.

UH, THERE WAS NO ASBESTOS IN THE CONCRETE.

AND WE HAVE DETAILED, UH, WORDING ON OUR PLAN, WHICH INDICATES HOW WE WILL HANDLE THIS GOING THROUGH THE CONSTRUCTION PROCESS, AND THAT WE WILL ONLY BRING CLEAN FILL ONTO THE PROPERTY, UH, IF ADDITIONAL FILL IS NECESSARY.

UH, THE BOTTOM LINE WAS THAT YOUR ENGINEER INDICATED THAT NO FURTHER ENVIRONMENTAL TESTING IS WARRANTED AT THIS TIME AND THAT THERE IS NO ENVIRONMENTAL IMPACT FROM THE PREVIOUS FILL.

UM, THE OTHER THING I WILL NOTE IS THAT YOU WILL SEE, UM, SOME AREAS OF STEEP SLOPE THROUGH THIS PROPERTY.

THIS WAS BASED ON LIDAR.

THERE ARE ACTUALLY SIX OF THOSE THAT ARE PART OF THE STORMWATER MANAGEMENT PLAN.

AND, UH, AS WE GET THROUGH EACH OF THESE MCMS, WE'LL GO INTO MORE DETAILS, BUT THERE'S ACTUALLY BMPS THAT ARE REQUIRED UNDER EACH OF THOSE.

UH, BUT JUST TO HIGHLIGHT WHAT THOSE SIX MS. MCMS ARE.

UM, FOUR IS CONSTRUCTION SITES, STORMWATER RUNOFF CONTROL FIVE, POST-CONSTRUCTION, STORMWATER MANAGEMENT IN NEW DEVELOPMENT AND REDEVELOPMENT.

AND THAT'S WHERE WE'RE LOOKING AT THE LAND DEVELOPMENT PLANS AND MAKING SURE THAT THEY'RE COMPLIANT WITH THE N P D S REQUIREMENTS AS WELL AS THE TOWNSHIP ORDINANCE.

AND FINALLY, MCM SIX BEING POLLUTION PREVENTION AND GOOD HOUSEKEEPING.

UH, SO WHAT IS MS FOUR? IT'S BASICALLY THE CONVEYANCE SYSTEMS THAT CARRY, UH, WATER FROM A MUNICIPALITY THROUGH DITCHES AND STORM PIPES, UM, AND OTHER INTO A SURFACE WATER.

UM, IT'S OWNED BY THE MUNICIPALITY OR CONTR, OR, UH, OPERATED.

AND IT'S NOT A COMBINED SEWER, MEANING THAT THERE IS NO SANITARY ASPECT TO IT.

IT'S JUST STORM WATER.

AND FINALLY, IT'S NOT PART OF A PUBLICLY OWNED TREATMENT WORKS.

UM, POLLUTANTS ARE ANYTHING THAT DEGRADES THE WATER QUALITY.

UM, IT COULD BE, UH, SEDIMENT, IT COULD BE PCBS, IT COULD BE BE, UH, ORGANIC, UH, COMPOUNDS AND DIFFERENT THINGS LIKE THAT.

UH, PCMS OR POLLUTANT CONTROL MEASURES.

THOSE ARE THE, UM, A ABOVE AND BEYOND REQUIREMENTS THAT, UH, UH, A MUNICIPALITY HAS TO DO, SUCH AS IF THERE ARE REQUIREMENTS FOR PCBS, SUCH AS ON THE SCHUEL RIVER, UH, WE WOULD'VE TO DO PCMS TO IDENTIFY IF THERE ARE ANY POTENTIAL SOURCES.

UM, BILL MENTIONED, UH, MR. DINGMAN MENTIONED EARLIER ABOUT THE POLLUTANT REDUCTION PLANS, P R P, UH, AND WE CURRENTLY HAVE ONE THAT'S APPROVED FOR SEDIMENT LOAD.

UM, WE LOOKED AT THE TOTAL SEDIMENT, UH, FROM THE MS FOUR, UH, CONTRIBUTING AREA, AND, UH, THE TOWNSHIP'S REQUIRED TO REDUCE THAT AMOUNT BY 10% IN THE FIVE YEAR PERMIT CYCLE.

AND FINALLY, STORM WATER IS ANYTHING THAT'S FROM THE SKY PRECIPITATION OR SNOW MELT, UM, SURFACE RUNOFF AND DRAINAGE OVER LAND DRAINAGE.

SO A POINT SOURCE IS ANY KIND OF DEFINED, UM, POINT OF FLOW.

IT'S A CONCENTRATED FLOW.

IT'S AS OPPOSED TO, UH, JUST OVERLAND FLOW COMING FROM OFF OF A FARM FIELD.

IT'S ACTUALLY A CONCENTRATED POINT OF FLOW WHERE YOU COULD ACTUALLY IDENTIFY WHERE THAT DISCREET POINT OR CONVEYANCE IS GOING INTO, UH, ANOTHER WATERWAY.

FINALLY, SURFACE WATERS ARE ANY KIND OF PERENNIAL INTERMITTENT STREAMS, UM, LAKES, WETLANDS, PONDS, UM, AND IT ALSO, UH, EXCLUDES ANY KIND OF, UM, INDUSTRIAL FACILITIES THAT HAVE THEIR OWN, OWN PERMIT, UH, SOURCES.

SO NO IMPOUNDMENTS OR COOLING WATER PONDS OR ANYTHING LIKE THAT.

NEXT SLIDE, PLEASE.

SO HERE'S THE DISTINCTION.

UM, A LOT OF PEOPLE LOOK AT AN END OF A PIPE, UM, GOING INTO A BASIN OR LEAVING A BASIN, AND THEY, AND THEY DEFINE THAT AS AN OUTFALL, BUT SPECIFICALLY OUTFALLS DIFFER FROM THOSE END WALLS IN THE SENSE THAT, UH, IF THAT FLOW GOES TO A CHANNEL, UH, THAT'S NOT A SURFACE WATER, BUT LIKE A SWALE, IT'S NOT THE POINT WHERE IT LEAVES THE PIPE, BUT THE POINT WHERE THAT SWALE ACTUALLY ENTERS THE SURFACE WATER.

SO D E P DEFINES THE ALPHA AS HAVING TO BE ON A SURFACE WATER.

SO THE POINT WOULD THEN BE MOVED FROM THE ACTUAL PIPE TO THE LOCATION WHERE IT ENTERS THE SURFACE WATER, AND THERE COULD BE MULTIPLE, UM, PIPES THAT GO INTO A SWALE, AND THEN IT GETS CONSOLIDATED DOWN INTO A SINGLE OUTFALL VERSUS MULTIPLE OUTFALLS.

THERE WOULD STILL BE ON YOUR MAP, A PIPE OUTLET OR AN END WALL, BUT THE ACTUAL POINT WHERE YOU OBSERVE WOULD BE THE FINAL POINT WHERE IT ENTERS THE SURFACE WATER.

AND ANOTHER POINT, UH, OF INTEREST WOULD BE WHERE YOU HAVE MS FOUR FLOWS GOING INTO A SEPARATE SYSTEM SUCH AS A PEN DOT OR ANOTHER MUNICIPALITY THAT POINT, UH, WHERE IT LEAVES THE TOWNSHIP'S MS FOUR AND GOES DOWNSTREAM INTO ANOTHER.

THAT POINT WOULD NO LONGER BE CONSIDERED AN OUTFALL, BUT INSTEAD IT WOULD BE AN OBSERVATION POINT.

SO YOU NEED TO BE ABLE TO MAP YOUR STREAMS AND YOUR OUTFALLS SO YOU, YOU KNOW, WHERE EVERYTHING'S CONNECTED.

AND USUALLY YOU DO THAT ALONG WITH BM P NUMBER THREE, WHICH IS YOUR ENTIRE SYSTEM.

SO IT'S YOUR PIPES AND YOUR ROADS AND, UM, INLETS, EVERYTHING LIKE THAT YOU HAVE ON A MAP.

AND FINALLY, WITH THAT MAP, THEN YOU CAN BREAK IT DOWN AND, AND DO YOUR OUTFALL SCREENINGS.

AND THESE SCREENINGS ARE, ARE DONE DURING DRY WEATHER.

AND IF THERE ARE CERTAIN FLOWS COMING OUT AFTER A PERIOD OF DRY WEATHER, WHICH IS TYPICALLY, UM, 48 HOURS OR 72 HOURS, UM, THESE, THEY'RE THEN THEY NEED TO BE SCREENED TO DETERMINE IF THERE'S A SOURCE OF, UH, ILLICIT DISCHARGE COMING OUT.

SO YOU'RE LOOKING AT SCENES OR COLOR OR SMELLS, AND YOU MAY NEED TO SAMPLE BASED ON THAT.

UH, SO THE PICTURE ON THE UPPER RIGHT WOULD BE KIND OF LIKE A DISCOLORED WATER, SO THAT WOULD WARRANT SOME SORT OF SAMPLING.

UM, BROKES THOSE OUT INTO FOUR AREAS, UH, TO HELP WITH INSPECTION SCHEDULING.

AND EACH OF THOSE FOUR AREAS IS INSPECTED FULLY, UH, ONCE EVERY FOUR YEARS.

AND THEY DO TWO INSPECTIONS FOR EACH OUTFALL DURING THAT PERIOD OF, DURING THAT YEAR PERIOD.

AND IN TWENTY TWENTY, A HUNDRED AND ELEVEN OUTFALLS WERE INSPECTED, AND THEY DID THAT TWICE, UH, IN 2021.

SO FAR, 89 OUTFALLS HAVE BEEN INSPECTED ONCE SO FAR, AND IN BOTH, UH, LAST YEAR AND THIS YEAR, NO ILLICIT DISCHARGES WERE DETECTED IN, UM, IN THOSE OUTFALL INSPECTIONS.

ALSO, I TELL THEM THAT IF THEY HEAR MY HORN TO STOP AND GO NO FURTHER, THEN CAME ROB, HE HAS PUT THE FAITH BACK
