SO I'M GONNA GO AHEAD AND CALL THIS TUESDAY, FEBRUARY 16TH, 2021, MEETING OF THE UPPER PROVIDENCE BOARD OF SUPERVISORS TO ORDER.

AND, UH, WE NORMALLY DO THE PLEDGE OF ALLEGIANCE AT THIS TIME, BUT IT'S A BIT PROBLEMATIC IN THE ZOOM FORMAT.

SO IF WE'LL JUST TAKE ABOUT 10 SECONDS OF SILENCE AND THINK ABOUT ALL THOSE WHO HAVE SUFFERED AND LOST THEIR LIVES DURING THE CURRENT PANDEMIC, THAT'D BE GREAT.

UH, I'M FIRST GONNA ASK FOR A MOTION TO APPROVE THE BOARD AGENDA, BUT I UNDERSTAND THAT WE HAVE ONE PRESENTER, ITEM 16 FOR THE STERLY TRACK ON GREENWOOD AVENUE, WHO HAS WITHDRAWN AT THE LAST SECOND.

UH, THERE, THERE'S A, A, AS SOME OF THE PEOPLE WHO ARE LOGGED ON, UH, I'M SURE, UH, ARE AWARE THERE HAVE BEEN, UH, CONCERNS ON THAT PROJECT WITH, UH, SOME ENVIRONMENTAL ISSUES.

WHEN WE WERE AT THE PLANNING COMMISSION, UH, WE DIDN'T YET HAVE THE PHASE ONE STUDY, AND WE DIDN'T HAVE AS MANY FACTS AS WE DO EVEN NOW.

UM, RIGHT NOW WITH WHAT, WITH WHAT WE HAVE FROM LOOKING AT THE PHASE ONE AND, UM, UH, AND THE INFORMATION THAT WE HAVE FROM THE APPLICANT, UH, WE

HAVE CONCERNS AT A STAFF LEVEL, UM, ABOUT THE, ABOUT MOVING FORWARD WITH, WITH ONLY THE PHASE ONE THAT WE HAVE NOW.

UM, AND I CONVEYED THAT TO THE APPLICANT'S ATTORNEY TODAY.

SO WHEN I TOLD HIM THAT THEY WOULDN'T BE ON THE AGENDA TONIGHT FOR ANY APPROVAL, HE SAID THAT HE UNDERSTOOD THAT THEY IMMEDIATELY BEGAN SCHEDULING SOME, UH, SITE STUDY, SOME BORING TESTS FOR THE SITE.

UM, THE ONLY POINT OF DISAGREEMENT BETWEEN US, UH, RIGHT NOW IS, UM, OUR ENGINEER, MR. DINGMAN, RIGHT NOW, IS RECOMMENDING SLASH REQUESTING A PHASE TWO SITE STUDY, AND THE APPLICANT ONLY WANTS TO MOVE TO A PHASE TWO IF THE TEST BORINGS, UH, SUPPORT, YOU KNOW, CREATE A CONCERN THAT WOULD LEAD TO A PHASE TWO THAT IS NOT YET A DECISION THAT HAS BEEN MADE.

UM, WE'RE RIGHT NOW, OUR POSITION, UH, IS THAT A PHASE TWO IS GOING TO BE REQUIRED FOR PRELIMINARY APPROVAL.

UM, IF THERE'S A, IF AFTER TALKING AND LOOKING AT THE SITE, THERE'S A RE A BASIS TO SAFELY, UM, REQUIRE SOMETHING LESS THAN A FULL PHASE TWO, WE WOULD CONSIDER THAT.

BUT AS OF AS OF RIGHT NOW, UM, IT'S NOT ON YOUR AGENDA BECAUSE WE'RE STILL WORKING THROUGH THAT ENVIRONMENTAL ISSUE.

UM, IN ALL OTHER RESPECTS, THEY ARE READY FOR PRELIMINARY APPROVAL, BUT THIS ISSUE IS, UM, IMPORTANT AND, YOU KNOW, WE WE'RE TREATING IT AS SUCH.

NEXT ON THE AGENDA, WE'RE, THIS IS A PUBLIC COMMENT TIME, BUT I JUST WANTED TO QUICKLY ACKNOWLEDGE THERE WAS GREAT INTEREST IN THE PRESENTATION BY DR.

RIFKIN, THE OWNER OF THE, UH, WHAT'S KNOWN AS THE PARKHOUSE PROPERTY AT OUR JANUARY MEETING.

AND, UH, HE HAS SUBMITTED A LETTER BACK TO THE BOARD, ESSENTIALLY ACKNOWLEDGING THE FEEDBACK THAT WE HAVE RECEIVED AND HE'S RECEIVED FROM THE COMMUNITY.

AND, UH, AT THIS POINT, THEY'RE WITHDRAWING THAT IDEA AND, UH, AND THEY'RE GONNA GO BACK TO THE DRAWING BOARD TO LOOK AT WHAT THEY CAN DEVELOP UNDER THE CURRENT ZONING OF THAT PROPERTY, WHICH IS THEIR RIGHT.

AND, UH, THERE WAS NEVER AN ISSUE TO BE VOTED ON BY THE BOARD.

AND I JUST WANNA PUT HIS LETTER IN THE RECORD SO THAT ALL INTERESTED CITIZENS CAN HAVE A LOOK AT IT IN, UH, TRANSPARENCY.

SO ANYWAY, UM, LET'S GO AHEAD AND WITH PUBLIC COMMENTS.

JEFF, LISA MOSSY HAD HER HAND UP FIRST.

LISA MOSSY, THREE 11 MONTGOMERY AVENUE OAKS.

UM, AT THE LAST TOWNSHIP MEETING, THIS BOARD DECIDED TO PLACE A PROPOSAL FOR THE PARKHOUSE PROPERTY ON ITS AGENDA.

UH, THIS IS THE LARGEST PARCEL OF OPEN LAND REMAINING IN THE TOWNSHIP.

AND THE CIRCUMSTANCES OF THE SALE WERE AMONG THE MOST CONTROVERSIAL AND EMOTIONAL IN MONTGOMERY COUNTY HISTORY.

AND THE ONLY NOTICE THE COMMUNITY WAS GIVEN ABOUT THIS PRESENTATION WAS THE QUIET POSTING OF THE AGENDA TO THE TOWNSHIPS WEBSITE.

IF SUPERVISOR AL BEG KNOWS, HE HADN'T TOLD ME ABOUT IT, I WOULD'VE NEVER KNOWN TO CHECK THE AGENDA FOR A PARKHOUSE ISSUE.

NOT A SINGLE ONE OF THE REMAINING SUPERVISORS REACHED OUT TO ANY RESIDENTS OR ACTUAL NEIGHBORS, AS IS THE CASE WITH SUPERVISOR KELSEY TO LET THEM KNOW THAT THIS PLAN WOULD BE COMING IN.

IT'S ALMOST AS IF THERE WAS A CONCERTED EFFORT TO MINIMIZE PUBLIC KNOWLEDGE OF THIS PLAN UNTIL IT WAS ALREADY TOO FAR ALONG INTO THE DEVELOPMENT PROCESS.

I HAVEN'T FORGOTTEN THAT THIS SAME TACTIC WAS USED BY THE COUNTY COMMISSIONERS WHEN THEY SOLD THIS LAND.

THEY OFTEN ADDRESSED QUESTIONS ABOUT THEIR TRANSPARENCY BY TALKING ABOUT THE NUMBER OF TIMES PARKHOUSE WAS ON A PUBLIC MEETING AGENDA, MEETINGS THAT WERE HELD AT 10:00 AM ON THURSDAY MORNINGS WHERE MOST PEOPLE WERE AT WORK.

NOW, THIS BOARD OF SUPERVISORS IS ADOPTING THE SAME STRATEGY BY DELIBERATELY ATTEMPTING TO KEEP A VOLATILE AGENDA ITEM AS QUIET AS POSSIBLE, EXCEPT INSTEAD OF HAVING YOUR MEETINGS AT 10:00 AM ON A WEEKDAY, YOU'RE QUIETLY HOLDING THEM VIA ZOOM.

THERE'S A DIFFERENCE BETWEEN LEADERS WHO DO WHAT'S RIGHT FOR THE COMMUNITY AND SELF INTERESTS, POLITICAL HACKS, WHO BE THE BARE MINIMUM FOR TRANSPARENCY WHILE HIDING BEHIND THE LETTER OF THE LAW.

THE COUNTY COMMISSIONERS WERE POLITICAL HACKS SEVEN YEARS AGO, AND NOW FOUR OF THE FIVE SUPERVISORS ARE POLITICAL HACKS.

TODAY ON JANUARY 19TH, I HEARD SUPERVISOR KELSEY ACTUALLY PROMOTING THIS PLAN.

THROUGHOUT THE PRESENTATION, I HEARD VICE CHAIR HIGGINS ASK NUMEROUS QUESTIONS ABOUT THE PROPOSED EQUESTRIAN CENTER.

AND ONLY, AND ONLY THE EQUESTRIAN CENTER HORSES DO NOT SEND THEIR KIDS TO SPRINGBOARD SCHOOLS.

THEY DO NOT PUT TRAFFIC ON OUR ROADS, AND THEY DO NOT IMPACT THE DELIVERY

OF FIRE AND EMERGENCY SERVICES.

AND EVEN THOUGH THIS WAS SUPPOSED TO BE ONLY A HIGH LEVEL PRESENTATION, I HEARD CHAIRMAN STARLING TALKING CONSIDERABLE AMOUNT OF DETAIL ABOUT ROAD IMPROVEMENTS THIS DEVELOPMENT WOULD REQUIRE.

SO IT WAS CLEAR THAT AT LEAST THREE OF THE SUPERVISORS HAD ENOUGH KNOWLEDGE ABOUT THIS PLAN BEFOREHAND TO CRAFT QUESTIONS ABOUT THEIR PET ISSUES.

AND STILL, NOT A SINGLE ONE OF THEM EVEN TOLD A NEIGHBOR ABOUT THIS PLAN BEING PLACED ON THE JANUARY AGENDA BEFOREHAND.

AND INSTEAD OF DISCOURAGING RIFKIN ON HIS ZONING CHANGE AND THEIR SECRET MEETINGS WITH HIM, THE SUPERVISORS ALLOWED HIM TO PRESENT THIS INCOMPLETE PLAN, WHICH FOCUSED ONLY ON AMENITIES THAT I DOUBT WILL EVER BE BUILT, AND WHICH INSULTED THE RESIDENTS OF THIS COMMUNITY BY OMITTING THE NUMBER OF HOUSING UNITS THAT WERE BEING PROPOSED.

THEN THE SUPERVISORS DOUBLED DOWN ON THIS INSULT WITH THE EMAILED STATEMENT FROM THE BOARD SIGNED BY VICE CHAIR HIGGINS.

IT WAS JU THIS STATEMENT USES THE WORD WE, BUT EVADES NAMING THE SUPERVISORS FOR WHOM SHE IS SPEAKING.

I KNOW ONE SUPERVISOR HAS UNEQUIVOCALLY STATED HIS OPPOSITION TO THE ZONING CHANGE, I PRESUME LORI HIGGINS'S LETTER SPEAKS FOR THE BALANCE OF THE FIVE MEMBER BOARD.

IN THE BOARD'S STATEMENT, HIGGINS TOLD RESIDENTS TO DIRECT THEIR CONCERNS TO THE DEVELOPER.

WHY WOULD ANY RESIDENT NEED TO TALK TO A DEVELOPER WHO'S PROPOSING A PLAN THAT DOES NOT CONFORM TO OUR ZONING? DR.

RIFKIN NEEDS A ZONING CHANGE FROM YOU, THE BOARD OF SUPERVISORS, BEFORE HE CAN BUILD THIS PLAN.

WE DON'T NEED TO LOBBY RIFKIN BECAUSE RIFKIN CAN'T CHANGE OUR ZONING ORDINANCES.

ONLY YOU CAN DO THAT.

SO ALLOW ME TO REMIND YOU THAT FOR MONTHS LEADING UP TO THIS SALE, DR.

RIFKIN INSISTED THERE WERE NO DEVELOPMENT PLANS AS PART OF THE PARKHOUSE DEAL.

THE PREVIOUS BOARD ASKED FOR PLANS ON THE LAND ON MULTIPLE OCCASIONS.

WE WERE TOLD THERE WERE NONE THE PUBLIC REQUESTED PLANS FOR THE LAND.

THEY WERE TOLD THERE WERE NONE NUMEROUS RIGHT TO KNOW REQUESTS WERE FILED AND IGNORED BY THE COUNTY ALL THE WHILE RIFKIN AND THE COUNTY COMMISSIONERS CLAIMING IN THE PRESS THAT HE HAD NO PLANS FOR THE LAND, AND HE WAS NOT A DEVELOPER.

IT WAS NOT UNTIL A RIGHT TO KNOW REQUEST FROM THE TIMES HAROLD WAS FINALLY GRANTED THAT THE SECRET DEVELOPMENT PLANS FOR PARKHOUSE PROPERTY WERE PRO WERE REVEALED.

AND I HAVE NOT FORGOTTEN THAT DR.

RIFKIN HAS LIED TO US BEFORE.

SO WITH REGARD TO WHETHER OR NOT THE SECRET MEETING BETWEEN RIFKIN, HIGGINS, AND KELSEY WAS TOTALLY COMPLIANT WITH SUNSHINE LAWS, WE ONLY HAVE SUPERVISOR HIGGINS WORD ON THAT SINCE NO ONE ELSE WAS PRESENT.

AND THERE ARE NO MEETING MEETING MINUTES OR RECORDINGS OF THAT MEETING AVAILABLE GIVEN THIS BOARD'S TRACK RECORD ON TRANSPARENCY THUS FAR.

FORGIVE ME IF I VIEW THIS STATEMENT WITH SKEPTICISM.

ANOTHER PART OF THE BOARD'S STATEMENT ATTEMPTS TO EDUCATE THE RESIDENTS AS THE PROPER COMPARISON OF THE DEVELOPMENT PLANS IS TO LOOK AT THE PROPOSED VERSUS FOR BY RIGHTS EXISTING ORDINANCE IN SPITE OF THE BOARD'S INSISTENCE TO THE CONTRARY, APPARENTLY A BY RIGHTS PLAN DOES EXIST FOR COMPARISON SINCE SUPERVISOR KELSEY SPECIFICALLY MENTIONED IT AT THE LAST MEETING, ASKING FOR ELABORATION ON QUOTE, WHAT WE COULD GET INSTEAD.

BUT LET'S LEAVE THAT ASIDE.

THE PROPER WAY TO LOOK AT THIS IS NOT FROM THE POINT OF VIEW OF THE DEVELOPER WHO'S ONLY HERE TO MAXIMIZE THE AMOUNT OF MONEY HE CAN MAKE FROM RAPING OUR LAND.

THE PROPER WAY TO LOOK AT THIS IS FROM THE POINT OF VIEW OF THE RESIDENTS OF THIS COMMUNITY, STARTING FROM ZERO, ZERO BUILDING, ZERO HOUSING UNITS, ZERO AMENITIES.

I KNOW THAT THE DOT, THAT THAT THE LETTER THAT WAS READ INTO THE RECORD TONIGHT IS AN ATTEMPT TO LULL US BACK INTO COMPLACENCY.

BUT I ALSO KNOW THAT RIFKIN HAS A LOT OF MONEY INVESTED IN THIS PROJECT, AND HIS FIVE YEAR TAX ABATEMENT ENDED IN 2019.

I BELIEVE HE'LL BE BACK WITH A FULL-BLOWN PLAN RIGHT AFTER THE GENERAL ELECTION IN NOVEMBER WHEN RIFKIN'S FRIENDLY BOARD IS SAFELY REELECTED.

SORRY.

BUT THIS BOARD OF SUPERVISORS HAD ONE OPPORTUNITY TO MAKE A FIRST IMPRESSION TO THE PUBLIC WITH THE PARKHOUSE PLAN.

YOU COULD HAVE INFORMED YOUR NEIGHBORS ABOUT THE MEETING.

YOU COULD HAVE WAITED UNTIL YOU BELIEVED YOU COULD SAFELY HOLD AN IN-PERSON MEETING.

YOU COULD HAVE ALLOWED EVERYONE TO SPEAK.

YOU COULD HAVE LET US KNOW THAT YOU WERE ON THE SIDE OF THE RESIDENCE AND UNDERSTOOD OUR YEARS OF CONCERN AND ANGST REGARDING THE FATE OF THIS PROPERTY.

INSTEAD, YOU QUIETLY POSTED IT TO AN AGENDA IN THE MIDDLE OF A DARK, SLEEPY JANUARY AND HID BEHIND A ZOOM MEETING WHERE RESIDENTS WERE MUTED AND SOME WERE NOT ALLOWED TO SPEAK.

YOU HAVE ALREADY FAILED IN YOUR OBLIGATION TO LOOK OUT FOR THE BEST INTERESTS OF THIS COMMUNITY BY ALLOWING THIS ABOMINABLE PLAN TO MOVE FORWARD AT A BOARD MEETING.

YOU MAY LIKE TO REMIND US THAT YOU LIVE HERE TOO, BUT YOUR SIMPLE FAILURE TO INFORM THE NEIGHBORS OF THE PUBLIC PRESENTATION OF THE PLAN WE'VE BEEN DREADING FOR YEARS, SUGGEST THAT WHILE YOU MAY LIVE IN OUR COMMUNITY, YOU ARE MOST CERTAINLY OUT OF TOUCH WITH IT.

I WILL NEVER FORGET ELIZA TRIAL SEVEN YEARS AGO FROM THE COUNTY COMMISSIONERS AND DR.

RIFKIN, AND I'M DISAPPOINTED AND ANGRY THAT OUR HOME BOARD OF SUPERVISORS ARE ENGAGING IN THE SAME TACTICS.

BUT I'M NOT SURPRISED AFTER ALL, THIS IS THE REASON WHY ALL FOUR OF YOU ARE HERE.

WHETHER YOU REALIZE IT OR NOT, THIS IS WHY WE EN CHANGED OUR ENTIRE SYSTEM OF TOWNSHIP GOVERNMENT FOUR YEARS AGO.

I'VE KNOWN THAT SINCE THE SALE OF THE FINAL WAS FINALIZED, THAT A PROPOSAL FOR DEVELOPMENT OF THIS PARCEL WAS INEVITABLE.

AND SO HAS, HE WAS JUST WAITING FOR A BOARD OF PATSYS WHO WOULD LIKE TO TAKE THE HEAT FOR UNNECESSARY ZONING CHANGE THAT ALLOWS HIM TO MAXIMIZE HIS PROFIT, BUT DOES ABSOLUTELY NOTHING FOR THE COMMUNITY.

UM, THE BOARD IS CONSIDERING GRANT PRELIMINARY LAND APPROVAL FOR THE STEELY TRACK AT 3 95 GREENWOOD AVENUE.

UH, EACH SUPERVISOR, THE TOWNSHIP MANAGER, ZONING MANAGER, TOWNSHIP SOLICITOR, HAVE RECEIVED AN EMAIL FROM US.

WE ARE A GROUP OF NEIGHBORS WHO LIVE ON GREENWOOD AVENUE OR WOODLAND DRIVE PROPERTIES THAT ARE NEAR THE PROPOSED DEVELOPMENT AT 3 95 GREENWOOD AVENUE.

FIRST OF ALL, WE AGREE THE STEELIES HAVE THE RIGHT TO DEVELOP THEIR PROPERTY FOR THE APPROPRIATE REGULATIONS, ZONING CODES AND PERMITS.

AND WE'VE EXPRESSED CONCERNS ABOUT THE ILLEGAL DUMPING THAT OCCURRED ON THIS PROPERTY IN THE LATE 1980S, AND THE TOWNSHIP AND THE REGULATORY BODIES INTERCEDED RESULTING IN LEGAL ACTION BY THE TOWNSHIP IN PENDOT AT THAT TIME.

AT THAT TIME, MR. STEELY WAS ONLY REQUIRED TO COVER THE DUMP MATERIAL WITH TOP SOIL.

THE DUMP MATERIAL IS STILL THERE.

IT IS VISIBLE ON THE RIDGE PIKE SIDE OF THE LANDFILL IN THE FORM OF LARGE SLABS OF CONCRETE AND REBAR.

WE HAVE PROVIDED AERIAL PHOTOS OF THE STEELY TRACK FROM THE 1970S UP TO THE PRESENT TIME, WHICH REFLECT THE VAST AREA THAT HAS BEEN FILLED BY THIS LANDFILL.

TRIAXLE DUMP TRUCKS CAME ONTO THE PROPERTY AND DUMPED THEM TO THIS LARGE AREA, ACRES OF IT FOR YEARS, AND MR. STEERLY PAID THE FINES ISSUED AND CONTINUED TO DUMP AGAIN, THE TOWNSHIP AND REGULATORY BODY INTERCEDED RESULTING A LEGAL ACTION OVER MR. STEELY ONLY COVERED THE DUMP MATERIAL WITH SOIL AND SEED, AND THE ILLEGALLY DUMPED MATERIAL IS STILL THERE.

NOW, WE'VE BEEN TO VARIOUS MEETINGS AND HAVE TALKED ABOUT THIS, AND, UH, I JUST WANNA SAY THAT I APPLAUD MR. UH, PRESIDENT'S COMMENTS TONIGHT THAT YOU'RE GONNA MOVE ON TO PHASE TWO TESTING AND ARE GONNA STAND FOR THAT.

AGAIN, CONTINUING FROM THE COMMENTS, UM, FROM CONCERNED RESIDENCE, AS TIM ARNOLD WAS STATING, UM, AT THE PLANNING COMMISSION MEETING LAST WEEK ON FEBRUARY 10TH, THE TOWNSHIP, UM, DID STATE THAT SINCE THE CASE WAS CLOSED, THEY WERE UNWILLING TO FURTHER CHALLENGE THE ILLEGAL DUMPING AND POSSIBLE RAMIFICATIONS TO THE TERM DETER DISTURBANCE OF THE MATERIAL DURING THE CONSTRUCTION OF THE DEVELOPMENT.

UM, WHILE THIS IS CLEARLY A LEGAL OPTION, IT IS CERTAINLY NOT THE ETHICAL THING TO DO.

UM, THEY DID INSTRUCT US TO MAKE OUR REQUEST FOR A SOIL STUDY IN AN ACT TWO INVESTIGATION AT THE SUPERVISOR MEETING TAKING PLACE TONIGHT.

AND THAT'S WHY WE ARE HERE.

UM, I AM EXTREMELY RELIEVED TO HEAR THAT YOUR ENGINEER IS REQ REQUIRING, UM, THE BORE SAMPLES AS BORING, AS WELL AS, UM, THE PHASE TWO.

I HOPE THAT YOU'LL STICK WITH THAT, UM, AND NOT MAKING IT A RESULTS BASED STUDY BECAUSE OF THE VAST, UM, AMOUNT OF, UH, DUMPING THAT TOOK PLACE.

UM, HOWEVER, UH, AND WE, UH, THE BUILDER DID STATE DURING THAT MEETING, UM, THAT THEY WOULD REMOVE ANY DEBRIS THAT THEY ENCOUNTERED DURING THE, DURING THE CONSTRUCTION.

UM, HOWEVER, THERE IS SO MUCH MATERIAL IN THIS

LANDFILL THAT DIGGING THROUGH IT AND REMOVING JUST THAT PORTION WILL AGITATE POSSIBLE CONTAMINANTS THAT REMAIN BURIED.

DISTURBING THE LANDFILL THROUGH CONSTRUCTION COULD CONTAMINATE THE AQUIFER THAT SUPPLIES THE WELL WATER IN OUR NEIGHBORHOOD, AS WELL AS THOSE IN THE SURROUNDING PV NEIGHBORHOODS AND THE WATER TOWER THAT SUPPLIES WATER IN CRANBERRY STATES.

IN OUR NEIGHBORING, UM, TOWNSHIP, WE ARE REFERENCING MATERIALS THAT HAVE BEEN BURIED IN THE SHALLOW SUBSURFACE FOR SOME 30 PLUS YEARS.

WHILE THIS IS A LENGTHY PERIOD OF TIME, IT IS NOT SO MUCH WHEN IT COMES TO PER WATER PERCOLATING INTO BED BEDROCK AQUIFER.

THIS TAKES TIME DEPENDING ON THE THICKNESS OF THE OVERBURDEN MATERIAL.

ONCE THIS BACKFILLS DISTURBED AND OPEN TO THE ELEMENTS, IT WILL HAVE THE CHANCE TO MOBILIZE, POTENTIALLY IMPACTING SURFACE AND GROUNDWATER.

AGAIN, AS TIM MENTIONED LAST NIGHT, YOU WERE SENT AN EMAIL INCLUDING A TIMELINE OF OUR EFFORTS TO REQUEST THE TOWNSHIP ENSURE THAT THE APPROPRIATE MEASURES ARE TAKEN IN, UH, TO EVALUATE ANY RISK OF CONTAMINATION.

PLEASE, UM, CONTINUE TO REVIEW THOSE DOCUMENTS, ESPECIALLY THOSE AERIAL, UH, PHOTOS THAT DEMONSTRATE THE MAGNITUDE OF MATERIAL THAT WAS DEPOSITED IN THE ILLEGAL LANDFILL.

EVEN THOUGH RESIDENTS HAVE HAD THEIR WATER TESTED WITH NO SURPRISES, CONTAMINANTS COULD EMERGE UP TO 10 TO 20 YEARS DOWN THE ROAD, A RESULT OF DISTURBING THIS MATERIAL, ASSUMING ONLY CONCRETE REBAR AND ASPHALT WERE RESERVE, WERE WERE USED AS BACKFILL.

THE MAJOR CONCERN WOULD BE BTX, BENZENE, TOLINE, ETHYL BENZINE, AND XYLENE AND PAHS PHOTOS, ACIDIC AROMATIC HYDROCARBONS.

BOTH ARE FOUND IN OIL PRODUCTS, WHICH ARE USED TO MAKE ASPHALT.

THESE COMPOUNDS WOULD NEED TO BE ON PART OF THE SOIL, SURFACE, WATER, AND GROUNDWATER SAMPLING LIST OF THE CONSTITUENTS TO BE TESTED.

UM, FINALLY, UM, THEREFORE, WE, UH, RESIDENTS ARE REQUESTING THAT BEFORE PRELIMINARY LAND DEVELOPMENT APPROVAL OF THE STEERLY TRACK AT 3 95 GRANT, UH, GREENWOOD AVENUE, UM, AN AND INDEPENDENT CONTRACTOR.

AND WE SPECIFICALLY WOULD LIKE AN INDEPENDENT CONTRACTOR TEST BOARDS TO PROVIDE A SOIL STUDY TO DETERMINE IF THERE ARE CLASS ONE, TWO, AND THREE CONTAMINANTS AS REFERENCED IN THE LETTER IN THE JULY 14TH, 1987 LETTER FROM THE D E R, WHICH WAS ATTACHED IN THE EMAIL I SENT AGAIN, UM, WE WOULD LIKE, AS RECOMMENDED BY YOUR ENGINEER, AN ACT TWO INVESTIGATION PERFORMED.

WATER QUALITY CHECKS IF CONSTRUCTION IS APPROVED, WATER QUALITY CHECKS CONDUCTED OVER THE CONDUCTED OVER THE COURSE OF CONSTRUCTION FROM THE SURFACE AREAS, CREEKS, AND THE POND FURTHER DOWN GREENWOOD, AND TO CONTINUE THE WATER QUALITY TEST FOR A MINIMUM OF 10 YEARS FOR THE NEARBY RESIDENCES TO ENSURE WATER SUPPLY REMAINS SAFE.

WE'D ALSO LIKE TO GUARANTEE THAT IF THE WATER SUPPLY DOES BECOME CONTAMINATED, THE TOWNSHIP WILL DO EVERYTHING IN ITS POWER TO LOCATE AND REDRILL WELLS TO ACCESS UNCONTAMINATED WATER, OR IF, IF NECESSARY, COVER ALL EXPENSES TO COMPLETELY CONNECT THE RESIDENTS TO PUBLIC WATER.

AND FINALLY, A REQUIREMENT THAT THE BUILDER PLACE FUNDS IN ESCROW FOR A MINIMUM OF 10 YEARS TO COVER THE EXPENSES REQUESTED ABOVE.

UH, AMONG THE ITEMS IN THE PLAN, UH, IT STATED THAT WE WOULD BE IN A DEFICIT OF 247 LIVING UNITS IN THE TOWNSHIP AT THIS TIME.

UH, I WOULD POINT OUT THAT AT LAST MEETING WE LEARNED THAT THERE WERE OVER 600 UNITS ALREADY APPROVED FOR DEVELOPMENT IN THE TOWNSHIP, BUT NOT YET

UH, AND I THINK THAT'S, UH, A CRITICAL ITEM, WHICH POINTS OUT THE NEED FOR THE COMPREHENSIVE PLAN TO BE REDONE.

THIS IS THE LAST SIGNIFICANT PARCEL OF UNDEVELOPED PROPERTY, EVEN MORE SO, THE NEED FOR A COMPREHENSIVE PLAN TO SEE HOW THIS FITS IN WITH THE, HOW THE TOWNSHIP HAS GROWN OVER THE LAST 10 YEARS.

UH, I WOULD ALSO LIKE TO POINT OUT, AS I DID IN MY EMAIL, THAT THE PARKHOUSE PROPERTY IS SPECIFICALLY MENTIONED ON PAGE 1 0 3, UH, AS IT IS RECOMMENDED, AND I'M QUOTING WITHIN THIS PLAN, THAT ANY FUTURE DEVELOPMENT OF THE SITE MAXIMIZE THE PRESERVATION OF THE EXISTING OPEN SPACE.

SHOULD THE COUNTY EVER DECIDE TO DIVEST ITSELF OF ANY OF THE GROUND, EVERY EFFORT SHOULD BE MADE TO MINIMIZE THE IMPACT OF ANY DEVELOPMENT THAT OCCURS.

AND THAT THEY ONLY, UH, ALLOW PROJECTS THAT MEET ALL THE REQUIREMENTS OF THE PROGRAM IN WHICH THE ONE THAT WE ARE RECOMMENDING DOES, UH, THE PROGRAM THAT WE WOULD LIKE TO SEEK FUNDS FOR, FOR THE TOWNSHIP IS IMPROVING THE PER AND TRAIL CROSSINGS AT SACRAMENTO ARCOLA, WHICH INCLUDES SOME VEGETATION CLEARING, SOME NEW TRAIL SIGNAGE, AND SOME ROADWAY PAVEMENT MARKINGS.

SO THE GRANT REQUEST AT THIS TIME IS FOR $33,590.

AS PART OF THE PROJECT, UH, THERE IS A REQUIRED MATCH BY THE COUNTY, WHICH IS AT LEAST 20%.

THE TOWNSHIP IS PREVIOUSLY EXPENDED FUNDS IN EXCESS OF THAT 20%, UH, ALLOWING THAT TO BE PART OF THE MATCH THAT WAS DONE IN SOME ENGINEERING AND SERVING SURVEYING TO GET TO THE POINT THAT WE ARE, OKAY.

UM, IN ORDER TO INSTALL THOSE SANITARY SEWER MAINS, MOST OF WHICH FALL WITHIN THE ROADWAYS, UM, WE NEEDED TO PROCURE, OR WE STILL NEED TO PROCURE EASEMENTS FROM ABOUT 12 PROPERTY OWNERS.

UM, BILL DINGMAN, JOE AND I HAVE MET WITH MOST OF THEM.

JOE HAS PREPARED THE EASEMENT AGREEMENTS, AND WE HAVE, UH, VERBAL AGREEMENTS WITH ALL OF THE PROPERTY OWNERS THAT YOU SEE LISTED ON THE SCREEN.

UH, THE SECOND CLASS TOWNSHIP CODE GIVES A PARK AND REC BOARD A CERTAIN LIST OF POWERS AND THEN SAYS, BUT THEY ONLY HAVE US WHAT POWERS THE TOWNSHIP GIVES THEM.

AND SO WE WANTED TO CONFIRM THAT THEY ARE PURELY ADVISORY, IT'S KIND OF LIKE WITH THE AUTHORITY OR PLANNING COMMISSION.

AND WE REMOVED A COUPLE OF THE SENTENCES THAT INDICATED THAT THEY HAD A SPEC SEPARATE BUDGET AND WOULD HA BE SPENDING MONEY OTHER THAN WHAT THE TOWNSHIP IS SPENDING, AND KIND OF TIGHTENED IT UP A LITTLE BIT SO THAT THEY'RE JUST MAKING RECOMMENDATIONS ON CERTAIN THINGS.

AND ALSO, YOU KNOW, ALSO TO CLARIFY THAT THE LIAISON IS STAFF, WHICH IS MS. HOFFMAN, YOU KNOW, NOT, SHE'S NOT A MEMBER OF THE BOARD.

THEY WEREN'T REALLY EVEN QUITE CLEAR ON THAT.

SO FIRST I'M GOING TO APOLOGIZE IF I GOT OUT OF HAND EARLIER, AND I THINK I MIGHT HAVE BECAUSE MY WIFE CAME INTO THE ROOM AND MADE GESTURES OF ME.

, YOU HAD THAT PROBLEM TOO, WHICH MAKES ME THINK I MIGHT BE IN A LITTLE BIT OF TROUBLE LATER, .

BUT ANYWAY, JUST REAL, REAL QUICKLY ON THESE ZONING ISSUES, AND I KNOW THESE ARE ALWAYS THE HOTTEST THINGS.

ALL OF US ARE VERY INTERESTED IN WHAT'S GONNA BE BUILT IN AND AROUND OUR HOMES AND OUR TOWNSHIP.

WE HAVE A ZONING MAP, WHICH PROTECTS US FROM JUST ANYTHING BEING PLOPPED DOWN ANYWHERE.

UM, AT THE CURRENT TIME, WE'RE DOWN TO LESS THAN 10% OF THE LAND IN THE TOWNSHIP LEFT DEVELOPABLE, UM, IS THE WORD I WOULD USE.

AND AT THIS TIME, UH, YOU KNOW, OVER THE YEARS, AND, AND I KNOW THIS, THAT PARKHOUSE IN PARTICULAR IS A HISTORICALLY SENSITIVE PROPERTY.

OVER THE YEARS, VARIOUS ZONING HAS BEEN PUT IN PLACE TO, UH, DIRECT WHAT CAN BE ZONED ON VARIOUS LAND.

ONE THING THAT WE CAN'T REALLY DO IS REZONE SOMETHING, UH, OUT FROM UNDER SOMEONE.

BUT IF YOU PURCHASE THE PIECE OF LAND ZONED A CERTAIN WAY, YOU SHOULD MAKE THE ASSUMPTION THAT IT'S GOING TO STAY THAT WAY.

BECAUSE FOR ME, AND I'M ONLY SPEAKING FOR BILL STARLING AS ONE SUPERVISOR, NOT AS THE CHAIRMAN OF THIS BOARD, AND CERTAINLY NOT FOR THIS BOARD, BUT FOR ME TO MAKE A ZONING CHANGE, THERE HAS TO BE AN OVERWHELMING AND COMPELLING INTEREST FOR THE TOWNSHIP TO DO THAT, ESPECIALLY AT THIS POINT IN OUR DEVELOPMENT HISTORY AS WE GET TO THE VERY END OF DEVELOPING LAND IN THE TOWNSHIP.

YOU KNOW, I WAS ASKED A QUESTION BY THE LEAGUE OF WOMEN VOTERS WHEN I RAN ABOUT BALANCING RESIDENTIAL VERSUS COMMERCIAL.

WELL, THAT'S NOT REALLY A BIG ISSUE IN THIS TOWNSHIP.

WE'RE OBVIOUSLY FAR BALANCED MORE TOWARDS RESIDENTIAL THAN COMMERCIAL, AND IT'S GOING TO STAY THAT WAY.

BUT THE REAL QUESTION FOR ME IS WHAT ARE THE FINAL TOUCHES WE'RE GOING TO PUT ON OUR TOWNSHIP? NOT ONLY WHAT WE ALLOW TO BE DEVELOPED, BUT WHAT KIND OF AMENITIES WE'RE GONNA ADD TO THE TOWNSHIP.

AND, UH, SO, YOU KNOW, THAT'S, THAT'S WHERE I COME AT THIS THING.

UH, YOU KNOW, AND, AND THEY'RE JUST FOR, FOR US TO MAKE ANY TYPE OF ZONING CHANGE.

I HOPE EVERYONE WILL SERIOUSLY CONSIDER, YOU KNOW, IS THERE REALLY A COMPELLING INTEREST FOR THE TOWNSHIP IN MAKING A CHANGE TO ANY ZONING? AND ONE OF THE REASONS I PERSONALLY WILL NOT ANSWER THE QUESTION, YOU KNOW, HOW WOULD YOU VOTE ON SOMETHING THAT'S NOT BEFORE ME IS ANOTHER THING I RAN ON WAS, I DON'T LIKE SPENDING MONEY ON LITIGATION.

I LOVE OUR SOLICITOR, MR. PRESIDENT, BUT HE'S MAKING PLENTY.

AND I DON'T REALLY , I DON'T NEED TO SEND HIM TO COURT ANYMORE OFTEN, BECAUSE THOSE ARE YOUR TAX DOLLARS THAT HAVE TO PAY FOR THAT LITIGATION.

SO IF THERE'S NOT SOMETHING BEFORE THIS BOARD, I'M NOT GONNA ANSWER HYPOTHETICALS AND THEN LATER BE CALLED OUT BY A DEVELOPER'S ATTORNEY FOR, YOU KNOW, PREJUDGING A SITUATION.
