MR. MCKENNA HAS SERVED THIS TOWNSHIP TO THE BEST OF HIS ABILITY.

BUT FIRST, I'D LIKE TO, TO, UM, RECOGNIZE, UH, SERGEANT ROBERT SOLARIO.

SERGEANT SOLARIO, UH, STARTED IN, UH, A LONG TIME AGO, 30 YEARS AGO, , UH, 1992.

AND, UH, ROB COMES FROM A, A FAMILY OF PUBLIC SERVANTS.

HIS FATHER, WHO'S IN SEATED HERE TODAY, MR. SOLARIO.

GOOD TO SEE YA.

UH, RETIRED FROM THE PLYMOUTH TOWNSHIP POLICE DEPARTMENT.

UM, HIS BROTHER RETIRED FROM THE PLYMOUTH TOWNSHIP POLICE DEPARTMENT.

SO HE COMES FROM A FAMILY OF, UH, OF LAW ENFORCEMENT AND, AND PUBLIC SERVANTS, UH, WHICH IS VERY COMMENDABLE.

30 YEARS IN AND OF ITSELF.

I IS VERY COMMENDABLE.

30 YEARS, ANYWHERE IS A LONG TIME, BUT HIS CAREER HAS REALLY BEEN STELLAR.

UH, HE CAME A YEAR AFTER I DID.

SO OUR CAREERS KIND OF, UM, MIMICKED EACH OTHER.

WE BOTH GOT DEPORTED, UH, UM, PROMOTED TO CORPORAL, UH, THEN SERGEANT, UH, AND HIS CURRENT RANK, HIS SERGEANT.

UM, BUT HE, HE SERVED ON THE SWAT TEAM FOR 20 YEARS.

HE'S CURRENTLY INVOLVED IN THE, UH, COMMUNITY, UH, ENGAGEMENT UNIT, WHICH ESSENTIALLY HIS JOB IS TO GO AROUND SOLVING, UM, QUALITY OF LIFE ISSUES FOR THE PEOPLE THAT LIVE IN OUR COMMUNITY.

AND HE'S BEEN VERY, VERY SUCCESSFUL WITH THAT.

UM, HE IS A TREMENDOUS ASSET TO OUR POLICE DEPARTMENT.

HE'S QUITE THE CELEBRITY, ACTUALLY, UH, DOWN IN OAKS ELEMENTARY, TO SAY THE LEAST.

HE'S THERE EVERY FRIDAY, UH, DOING HIGH FIVE FRIDAYS.

UH, THEY CELEBRATED DOWN THERE ACTUALLY, UM, UH, UH, A FEW WEEKS AGO, HIS 30 YEARS, BECAUSE THEY WANTED TO DO SOMETHING FOR HIM TOO.

SO, WE'RE VERY HONORED AND GRATEFUL THAT HE'S BEEN WITH US FOR 30 YEARS.

AND, UH, ROB, WHEN YOU COME ON UP, WE HAVE A PLAQUE FOR HIM TO RECOGNIZE THAT HE'S A MAN OF FEW WORDS, BUT YOU GONNA SAY ANYTHING? NO.

UH, THE PLAQUE READS AN APPRECIATION FOR 30 YEARS OF DEDICATED AND OUTSTANDING SERVICE TO THE COMMUNITY OF UPPER PROVIDENCE TOWNSHIP AND THE UPPER PROVIDENCE TOWNSHIP POLICE DEPARTMENT WITH SERVICE IN PATROL, SWAT, FIREARMS UNIT, CRASH INVESTIGATION UNIT, MOTOR UNIT, DRONE PROGRAM, AND COMMUNITY OUTREACH.

WE'VE BEEN THROUGH A LOT SWAT TEAM, BUT, UH, YOU KNOW, THE TOWNSHIP HAS ALWAYS TREATED ME REALLY GOOD.

I'VE ALWAYS LOVED HERE.

I'VE MOVED INTO THE COMMUNITY, AND, UH, I HAVE A VESTED INTEREST.

EVERY PART OF, YOU KNOW, THE COMMUNITY, OUR YOUNGER GENERATION WANT THEM TO GROW UP AND RESPECT, YOU KNOW, WE'RE THEIR FRIENDS, BUT REALLY, I WANT THANK MY WIFE.

SHE'S THE ONE SUPPORT, UH, YOU MY JOB.

ALL RIGHT.

THE, UM, THE SECOND, UH, RECOGNITION TODAY IS GONNA BE A LIFESAVING, UH, RECOGNITION AWARD.

UM, AND I WANTED TO DESCRIBE THE INCIDENT TO YOU, BUT I CAN TELL YOU FROM DOING THIS JOB AS LONG AS ROB AND A LITTLE BIT LONGER, UM, WHEN WE, WE DO THIS JOB FOR MANY REASONS, UH, MOST OF US GETTING THIS JOB BECAUSE WE WANT TO GIVE BACK AND WE WANT TO SERVE.

WHEN YOU HAVE THE OPPORTUNITY TO ACTUALLY, UH, PUT YOUR SKILLS IN TRAINING, UH, IN A POSITION TO SAVE SOMEONE'S LIFE, THAT IS ONE OF THE GREATEST FEELINGS ONE COULD EVER, UH, UM, ENCOUNTER.

SO I AM VERY GRATEFUL FOR ALL THE PEOPLE THAT WE'RE GONNA RECOGNIZE HERE TODAY, UH, INCLUDING THE FAMILY.

UM, BUT HERE'S THE INCIDENT.

ON WEDNESDAY, OCTOBER 12TH, 2022, AT APPROXIMATELY 5:33 PM EMS, FIRE AND POLICE WERE DISPATCHED AT 5 98 BUR LINE ROAD, LOCATED IN THE COLLEGEVILLE SECTION OF UPPER PROVIDENCE TOWNSHIP.

FOR THE REPORT OF A CARDIAC ARREST.

BARBARA GONZALEZ REPORTED THAT HER HUSBAND, DAVID DAVID GONZALEZ, WAS UNCONSCIOUS AND DISPLAYED AGONAL BREATHING.

BARBARA BEGAN PERFORMING CPR UNTIL EMERGENCY PERSONNEL ARRIVED.

IT JUST SO HAPPENS THAT UPPER PROVIDENCE TOWNSHIP FIRE CHIEF MIKE RIFFLE, WAS, UH, IN THE AREA AND ARRIVED ON THE SCENE AND ASSUME CPR FROM HER UNTIL UPPER PROVIDENCE TOWNSHIP POLICE OFFICER, UH, SERGEANT SCOTT REYNOLDS ARRIVED WITH THE AUTOMATED, UH, EXTERNAL DEFIBRILLATOR.

AND A E D SERGEANT REYNOLDS OPENED THE DEVICE, AND CHIEF RUSSELL APPLIED THE PADS.

AND SERGEANT REYNOLDS ADMINISTERED ONE SHOCK TO DAVID GONZALEZ.

CHIEF RUSSELL TOOK COMMAND OF THE SCENE AND DIRECTED ARRIVING FIRE AND EMS PERSONNEL TO RESUME CHEST COMPRESSIONS AND RESCUE BREATHING PARAMEDIC BILL REESE.

OH, I'M SAYING THAT RIGHT.

AND EMT MORGAN REESE DELIVERED LIFESAVING MEDICATIONS AND ADVANCED LIFE SUPPORT INTERVENTIONS WITH ASSISTANCE FROM UPPER PROVIDENCE TOWNSHIP, FIREFIGHTER SLASH EMT, STEVE MCCOY, TRAP FIRE COMPANY ENGINEER RICK SCHROEDER AND TOWNSHIP FIRE COMPANY LIEUTENANT SLASH EMT STEVE CINI.

THROUGH THE INCREDIBLE EFFORTS OF BARBARA GONZALEZ AND THE RESPONDERS ON SCENE, DAVID GONZALEZ IS HEART BEGAN TO BEAT CORRECTLY, RESULTING IN THE RETURN OF SPONTANEOUS CIRCULATION.

DAVID GONZALEZ WAS ULTIMATELY TRANSPORTED TO THE HOSPITAL WHERE HE RECEIVED ADDITIONAL MEDICAL TREATMENT.

DAVID WAS ABLE TO RECOVER AND WAS HOME AS SOON AS TWO DAYS LATER.

DAVID IS HERE TONIGHT WITH HIS WIFE, BARBARA.

TONIGHT WE WANT TO CELEBRATE THE TREMENDOUS SERVICE AND TEAMWORK PUT ON DISPLAY BY ALL OF OUR FIRST RESPONDERS, AND ESPECIALLY BARBARA GONZALEZ THIS'S, UH, HEROIC ACTIONS.

I'M A, I'VE BEEN A, A PHYSIOLOGY TEACHER, UH, FOR QUITE A WHILE AT TWO DIFFERENT COLLEGES AND FINISHED MY CAREER UP AT MANCO.

UH, MY WIFE IS, SHE WORKS FOR, UH, AS A SUBCONTRACTOR FOR HOMELAND SECURITY, LOOKING FOR BIOLOGICAL WEAPONS.

UH, SO WITH THAT, I, I CAN'T TELL YOU HOW MUCH I APPRECIATE EVERYBODY THAT WAS INVOLVED IN, IN SAVING MY LIFE.

I HOPE TO CONTINUE CONTRIBUTING IN ONE WAY OR ANOTHER.

UH, I CAN'T TELL YOU HOW MUCH I APPRECIATE IT IN, IN ALL, ALL THE EMTS, UH, THE, THE POLICE DEPARTMENT, THE POLICE OFFICERS INVOLVED.

YOU KNOW, LOOK, LOOK AT ME.

UH, ON MY SECOND TRIP TO THE HOSPITAL, I, I GOT TO MEET AN E M T WHOSE SHIRT I GRABBED AND HELD ON BECAUSE I WAS IN SUCH SEVERE PAIN.

AND THAT WAS BECAUSE BOTH MY, MY VEINS AND MY LEFT ARM GOT OCCLUDED.

SO I HAD TO TAKE ANOTHER TRIP TO THE HOSPITAL, SPEND A FEW MORE DAYS, AND I PROMISED HIM THAT I'D GIVE HIM MY LECTURES.

I DON'T KNOW IF HE'S HERE TODAY OR NOT, BUT, YOU KNOW, I, I HAVE MY LECTURES AND MY, MY MEDICAL STUDENTS AND MY NURSING STUDENTS TEST TESTIFY TO THEM.

IF HE'S NOT HERE, THEN I'M WILLING TO GIVE 'EM TO ANYBODY ELSE CUZ HE CAN ALWAYS PICK UP A COPY.

UH, THEY'RE FREE.

AND LIKE I SAID, MY, MY NURSES STUDENTS IN PARTICULAR REALLY TESTIFIED TO THEM.

UM, WHICH WAS OBVIOUSLY IN HIS CASE, ABSOLUTELY VITAL TO MY HUSBAND.

NOT ONLY SURVIVING, BUT HE IS, THERE'S JUST NO RE NO REPERCUSSIONS, WHICH IS COMPLETELY AMAZING.

UM, AND ALSO MY THANKS TO THOSE IN THE AMBULANCE WHO WERE WITH HIM WHILE HE WAS BEING TRANSPORTED TO THE HOSPITAL AND KEEPING HIM STABLE.

AND SO HE GOT THERE.

UM, IT WAS A TRAUMATIC DAY.

I WILL NEVER EVER FORGET WHAT HAPPENED.

UM, BUT WHAT A DIFFERENCE YOU ALL MADE.

UM, I'VE COME TO REALIZE THAT THE OUTCOME THAT WE GOT WAS, UM, COULD HAVE BEEN SO VERY, VERY DIFFERENT.

SO VERY EASILY DIFFERENT BASED ON MY HUSBAND'S INJURIES.

UM, AND THAT WAS DUE TO EVERYONE THAT WAS INVOLVED, AND THAT'S WHY WE GOT SUCH A POSITIVE OUTCOME.

UM, I CAN ONLY IMAGINE THAT YOUR JOBS CAN BE SO VERY DIFFICULT AT TIMES.

UM, BUT IT'S SO VERY, VERY IMPORTANT.

THE GAME STILL HAS TO BE PLAYED.

THE HEARING STILL HAS TO BE HELD.

SO WHAT THE LAW TELLS US IS THAT THE SUPERVISORS HAVE TO PROVIDE A FAIR HEARING.

THAT MEANS NOT TAKING A POSITION IN ADVANCE.

IT MEANS THEY CAN'T SAY THINGS LIKE, WE WILL DENY IT OR WE'RE ON YOUR SIDE.

SO WE WILL DENY IT.

THEY'LL DECIDE THE CASE ON THE BASIS OF WHAT THE EVIDENCE SAYS.

UM, AND BACK WHENEVER IT WAS 2013 OR AT SOME POINT, AN INSTITUTIONAL OVERLAY WAS PUT ON VARIOUS PARCELS AROUND THE TOWNSHIP.

UM, THIS PARTICULAR PARCEL IS NOT LISTED UNDER YOUR INSTITUTIONAL OVERLAY.

UH, I WENT THROUGH EVERY SINGLE ONE.

THERE'S ABOUT TWO PAGES OF THEM IN THE OFFICIAL TOWNSHIP DOCUMENTS.

UM, AS YOU KNOW, THE DEVELOPER IS CURRENTLY PROPOSING ABOUT 1200 UNITS ON THIS PROPERTY, WHICH ARE RESIDENTIAL.

NOW, FROM WHAT I'VE READ IN THE TOWNSHIP ORDINANCES IN OSC AND IN I N RESIDENTIAL IS NOT ALLOWED.

THAT'S, THAT'S IN YOUR, YOUR TEXT EVEN UNDER CONDITIONAL USE RESIDENTIAL IS NOT ALLOWED IN THESE TWO ZONING DISTRICTS.

AS RESIDENTS OF THE UPPER PROVIDENCE TOWNSHIP, WE STRONGLY ENCOURAGE YOU TO DEFEND THE CURRENT ORDINANCE AND VOTE NO WHEN THAT COMES TO YOU.

UH, ON THE APPROVAL OF THE PARKHOUSE PLAN, WHICH AS WE ALL KNOW, UH, HAS PROPOSED 1,203 UNITS.

AS IT STANDS, THE OWNER IS SAYING THAT ONLY A SMALL PORTION OF THE 1,203 UNITS ARE SENIOR UNIT'S.

APARTMENTS WOULD BE ASSISTED LIVING IN ORDER TO MEET YOUR ZONING.

ALL OF THE PROPOSED SINGLE FAMILY HOMES, MULTI-DWELLING UNITS, TOWNHOUSES, APARTMENTS, WOULD REQUIRE LICENSURE TO MEET THE CONDITIONAL USE DEF DEFINITION WITHIN THE TOWNSHIP ORDINANCE.

NOTHING LESS THAN THAT, EVEN IN A SMALLER PORTION OF 414 SENIOR APARTMENTS, IF THEY WERE LICENSED, THIS WOULD SIMPLY JUST BE A HIGH DENSITY HOUSING COMMUNITY NEXT TO A LICENSED ASSISTED LIVING UNIT.

IT'S ALSO MY UNDERSTANDING, AS WE'VE HEARD FROM, UH, SOLICITOR RESIDENT, THAT CONDITIONAL USE IS THE BURDEN OF PROOF FOR THE APPLICANT.

SO MY QUESTION IS, IS WHAT DETAIL TO DOCUMENTS AND PROPOSAL HAS THE OWNER PROVIDED TO THE TOWNSHIP THAT YOU HAVE PERSONALLY REVIEWED OR WILL BE REVIEWING TO DETERMINE THAT THE PLAN IS CONSISTENT WITH THE EXISTING CODES? IF THE DOCUMENTS EXIST, WE WOULD LIKE TO SEE THEM.

UM, IN THE 1222 OR IN THE DECEMBER, UH, SEVENTH, UH, MEETING WITH THE PLANNING COMMISSION, THE WAR STER DECISION CERTAINLY WAS REFERENCED.

UM, IT IS RELATED TO A DEVELOPMENT AS I READ, AND I'M NOT AN ATTORNEY OF WHAT WAS BEING PROPOSED FOR A CONTINUING CARE FACILITY, WHICH IS DIFFERENT THAN THIS APPLICATION.

IN DECEMBER, THE PLANNING COMMISSION MEETING, I VOICED MY CONCERNS ABOUT THE INFRASTRUCTURE, THE TOWNSHIP.

THIS IS A MAJOR CONCERN OF OUR NEIGHBORS AS WELL.

IF THIS IS BUILT APPROXIMATELY 1200 HOUSING UNITS WITH APPROXIMATELY TWO PERSONS TO EACH UNIT, THE INCREASE OF THE POPULATION WILL BE BY 10% OF THIS TOWNSHIP.

IT'S TAXING AND ALREADY STRAINED INFRASTRUCTURE OF OUR CLO ROADS, INCREASING THE NEED FOR MORE FIRE, EMS, POLICE SERVICES, RAISING OUR TAXES AND AFFECTING THE PROPERTY VALUES.

THE TRAFFIC IS ALREADY SUBSTANTIAL AT ROUTE ONE 13 IN THE SECOND AVENUE IN DRIVEBYS ROAD.

I TAKE MY LIFE IN MY HANDS EVERY DAY.

I COME OUT, GO TO WORK, AND COME HOME EVERY DAY.

WE ALSO NOTICE THAT THERE WAS A RECENT CHANGE IN THE STOP SIGN, WHICH IS ONLY CAUSING INCREASED CONGESTION AND MORE CONFUSION AROUND THE ROAD PATTERNS.

SO WE WOULD LIKE TO, I IMP IMPRESS UPON THE, THE SUPERVISORS TO COMPLETE A TRUE TRAFFIC IMPACT STUDY OF THE TOWNSHIP ROADS, OLD STATE ROAD, YAGA ROAD, OLD SOUTH TRAP ROAD AND SECOND AVENUE.

WE ALSO WOULD LIKE TO MAKE A RECOMMENDATION AROUND THE DEVELOPER, UH, IF, IF THIS PLAN GOES FORWARD, THAT THERE HAS TO BE A STORM MANAGEMENT OR INFILTRATION TESTED C TESTING COMPLETED BEFOREHAND.

WE HAVE ALREADY EXPERIENCED THE BURDEN OF APPROVING OVER AMBITIOUS PLANS, WHICH HAVE FAILED AND THEN BECAME A FINANCIAL BURDEN TO THE TAXPAYERS OF THIS TOWNSHIP.

TRULY HAVE NO IDEA WHAT THAT IS.

MY POINT IN ALL OF THIS IS THAT THE NONPROFIT USED A TREE AS THEIR LOGO, AND MR. MULLEN'S LAW FIRM TOOK IT UPON THEMSELVES TO SEND A LETTER FROM THE FRIENDS OF WARCHESTER LLC, WHICH WAS A CORPORATION THAT HE ESTABLISHED, OR THAT HIS LAW FIRM DID TO IMPERSONATE THE NONPROFIT, UM, ORGANIZATION.

AND THEY WENT SO FAR AS TO USE THEIR TREE LOGO.

SAME THING.

MIGHT AS WELL BE FROM THAT NONPROFIT.

UM, THEY SENT A LETTER TO ALL THE HOMEOWNERS IN THAT TOWNSHIP INDICATING THAT THE FRIENDS OF WARCHESTER, WHICH FOR ALL INTENTS AND PURPOSES LOOKED LIKE THE NONPROFIT ORGANIZATION SUPPORTED THE DEVELOPMENT WHEN THEY 100% DO NOT.

SO EVENTUALLY HE WAS TAKEN TO COURT APPEAL, APPEAL, APPEAL, WHATEVER.

UM, HE WAS HAD TO ULTIMATELY OWN UP TO THE FACT THAT HIS LLC WAS NOT THE NONPROFIT AND HE HAD TO SEND A LETTER APOLOGIZING.

BUT WE ALL KNOW THAT NOBODY READS THE RETRACTIONS, THE DAMAGE HAD BEEN DONE.

SO HERE'S MY THING.

THE LAST TIME I WAS HERE ABOUT PARKHOUSE WAS A ZOOM MEETING, WHICH PRESENTED QUITE A DIFFERENT PLAN THAN WHAT WE'VE ALL SEEN, UH, LAST MONTH AT THE PLANNING SESSION.

SO WITH THAT SAID, I'LL TRY TO KEEP IT SHORT.

ONE OF THE THINGS THAT WE'RE WORRIED ABOUT IS THAT WE UNDERSTAND WHEN ORIGINALLY SOLD TO THE DEVELOPER BY THE COUNTY, AND UNFORTUNATELY THE COUNTY HAS HAD A PART IN THIS IN THE PAST, THAT ONLY 15% WAS DEEMED DEVELOPABLE DUE TO THE WATER FLOW RATES IN THE COUNTY, IN THE AREA OVER HERE OF PARKHOUSE.

THIS IS NOT REFLECTED IN THE CURRENT PLAN.

WE DON'T BELIEVE IN FACT FLOODING ISSUES CURRENTLY, A MAJOR PROBLEM IN THE AREA WILL INCREASE SIGNIFICANTLY.

THE PARKHOUSE PROPERTY, STORMWATER RUNOFF, DRAINS INTO THE CHUKA RIVER UPSTREAM FROM MONTCLAIR.

THIS WILL MAKE MATTERS WORSE IN UPPER PROVIDENCE, MONTCLAIR, AND THE SURROUNDING COMMUNITIES.

AND THEN THIRD, UM, THAT YOU MENTIONED THE TRAGIC ACCIDENT ON THE 23RD, UH, WHICH RESULTED IN A POWER OUTAGE TO, UH, A LARGE AREA.

THE, THE ENTIRE PERKIN WOODS DEVELOPMENT, WHICH WAS THE, THE ONE OF THE LARGEST DEVELOPMENTS IN THE TOWNSHIP, UM, WHEN THE TEMPERATURES RANGED ANYWHERE FROM ZERO TO FIVE.

UM, SO IT, IT, THE POWER WAS OUT FOR ALMOST 24 HOURS.

UM, AND I KNOW THAT A LOT OF YOU HAD SPOKEN, UM, BUT I WANT TO RECOGNIZE THAT DURING, DURING THAT TIME PERIOD, IT WAS, UM, THAT THE POLICE DEPARTMENT, THE FIRE DEPARTMENT, PUBLIC WORKS, WHO AT THE SCENE WAS INVALUABLE TO US TO, UH, GAIN ACCESS FOR US.

AND THEN PARKS AND RECREATION, WHO AT THE DROP OF A PHONE CALL SHOWED UP, WE OPENED UP THE COMMUNITY CENTER AND OPENED AS A WARMING CENTER.

SO, UM, WHEN CHIEF FREEMAN TALKED EARLIER ABOUT THE COOPERATION WITHIN THE TOWNSHIP, IT, IT CERTAINLY CAME THE PAST, UH, IN THOSE 24 HOURS WHERE ALL THE DEPARTMENTS DID EVERYTHING WE COULD TO, TO DO EVERYTHING WE CAN TO MAKE THE TOWNSHIP PROUD, TO TAKE CARE OF THE RESIDENTS THAT, UM, WERE TRULY IN NEED AT THAT POINT.

SO THANK YOU AND THANK YOU FOR, REMEMBER FOR MENTIONING PUBLIC WORKS.

I ALWAYS FORGET, AND THESE GUYS, THEY CAN BE CRITICAL, ESPECIALLY IN THESE BIG PROBLEMS, FLOODING, WHATEVER, THEY, THEY'RE THERE AND THEY GET IT DONE.

THE STORM WATER DECISION.

YEAH.

UM, AND FOR THE BENEFIT OF THOSE PEOPLE WHO ARE, WHO ARE HERE ALSO, UM,

UNDER A FEDERAL PROGRAM CALLED MS. FOUR, MUNICIPALITIES ARE REQUIRED TO TAKE, UH, STRONGER AND STRONGER STEPS TO CAPTURE STORM WATER TO PREVENT POLLUTION IN THE STORM WATER FROM ENTERING, UH, THE RECEIVING BODIES.

THAT PROGRAM'S BEEN IN PLACE FOR OVER 10 YEARS, BUT IT'S, IT'S BEEN SLOW AND RAMPING UP TO ACTUALLY DOING STUFF.

SO THE FIRST FEW YEARS WE'RE EDUCATIONAL PROGRAMS AND THINGS LIKE THAT, AND NOW WE'RE TO THE POINT WHERE WE HAVE TO ACTUALLY START DOING THINGS.

AND A LOT OF MUNICIPALITIES AROUND THE STATE HAVE ALREADY ADOPTED A STORMWATER FEE AS A WAY TO, UH, CUZ IT'S AN UNFUNDED MANDATE FROM THE FEDERAL GOVERNMENT, LIKE SO MANY.

UM, AND THERE ARE MUNICIPALITIES THAT HAVE, UH, ENACTED A STORMWATER FEE HERE IN THE TOWNSHIP THROUGH THE MUNICIPAL AUTHORITY.

UH, YOU REPURPOSED THEM TO MAKE RECOMMENDATIONS TO YOU FOR THE STORMWATER FEE.

WE AMENDED THEIR CHARTER TO ALLOW THEM TO DO THAT.

UM, AND WE HAVE BEEN IN THE PROCESS OF WORKING UP A POSSIBLE STORMWATER FEE.

AND, UM, THERE WAS A, THERE'S A CASE THAT'S BEEN PENDING, SO WE HAD SORT OF PUT EVERYTHING ON HOLD.

THAT CASE WAS DECIDED, UH, A COUPLE WEEKS AGO OUT OF WESTCHESTER.

UM, WESTCHESTER UNIVERSITY REFUSED TO PAY THE FEE ON CLAIMING THAT IT WAS NOT A FEE, THAT IT WAS REALLY A TAX, UM, TAX.

TAX EXEMPT ENTITIES, LIKE INSTITUTIONS DON'T HAVE TO PAY TAXES, BUT THEY DO HAVE TO PAY FEES.

TA TAXES RAISE MONEY.

THEY'RE A GENERAL MONEY RAISING MECHANISM FOR THE OVERALL PUBLIC.

GOOD FEES ARE SOMETHING THAT RE REFLECT THE COST OF ACTUALLY PROVIDING SOMETHING TO SOMEONE.

SO LIKE WE HAVE OUR SEWER TAPPING FEE, THERE'S A SPECIFIC FORMULA THAT YOU USE AND THEN IN RETURN YOU GET TO CONNECT TO THE SYSTEM.

SO THE PENNSYLVANIA COMMONWEALTH COURT, WHICH IS ONE OF THE TWO APPEALS INTERMEDIATE APPEALS COURTS, VOTED A COUPLE WEEKS AGO THAT IT ON THE WESTCHESTER CASE AND SAID IT IS A TAX, IT IS NOT A FEE, IT IS A TAX.

UM, THE IN IN SEPARATELY, THE SECOND CLASS TOWNSHIPS WERE GIVEN THE POWER TO ADOPT THIS SPECIFICALLY AS A, A FEE BY THE LEGISLATURE.

AND THAT PART'S A LITTLE BIT CONFUSING, BUT THE BOTTOM LINE FOR RIGHT NOW IS THAT ANY MONEY THAT'S RAISED BY THE TOWNSHIP TOWARDS THESE STORMWATER IMPROVEMENTS CAN ONLY BE DONE AS A TAX.

UM, AND THAT MEANS THAT THE TAX EXEMPT ENTITIES ARE AGAIN EXEMPT EVEN THOUGH THEY HAVE IMPERVIOUS PROPERTY THAT, YOU KNOW, YOU COULD MAKE THE ARGUMENT THEY SHOULD PAY THEIR FAIR SHARE TOWARDS THE PROGRAM, BUT WITH A TAX THEY WOULD NOT BE REQUIRED, UH, TO DO THAT.

PLUS IT ALSO FURTHER BURDENS THE OVERALL TAXING, UH, POWER OF THE TOWNSHIP BY ADDING THAT AS A TAX.

SO, UM, THERE ARE SOME DECISIONS THAT HAVE TO BE MADE, BUT I DON'T THINK THEY HAVE TO BE MADE UNTIL WE SEE WHETHER THE SUPREME COURT ACCEPTS THE CASE.

THE, UM, PENNSYLVANIA SUPREME COURT, LIKE THE US SUPREME COURT DOESN'T HAVE TO TAKE APPEALS.

IT DECIDES WHETHER IT WILL TAKE APPEALS.

SO WE'RE WAITING, I ASSUME THAT ONE OF THE PARTIES IS GOING TO AS APPEAL IT TO THE SUPREME COURT FOR REVIEW AND WE'LL SEE WHAT HAPPENS AND THEN, THEN MAKE HARD DECISIONS ABOUT, YOU KNOW, WHETHER TO DO IT AS A TAX, UH, IF IT, IF IT, IF THE CASE IS UPHELD.
