NEARLY A DOZEN BULLET HOLES HIT THE WINDSHIELD OF THE SUSPECT'S VEHICLE DURING THE SHOOTOUT.

EARLY THIS MORNING, OUR MARCUS ESPINOZA HAS THE DETAILS.

THAT CELL PHONE FOOTAGE SHOT BY A NEIGHBOR SHOWS THE PERSPECTIVE OF WHAT IT'S LIKE TO BE SO CLOSE TO IT, SHOOTOUT, AND JUST HOW DANGEROUS THAT SCENE WAS.

EARLY WEDNESDAY MORNING, LET THE GUNNY CLUE OUT.

WE DON'T WANNA HURT YOU.

HE JUST SHOT AT HIM A SHOOTOUT BETWEEN A MAN AND MEMBERS OF SWAT AND POLICE AT SCENE IN THIS CELL PHONE FOOTAGE AT THE MEADOWS APARTMENT COMPLEX IN THE MONTCLAIR SECTION OF UPPER PROVIDENCE TOWNSHIP, JUST AFTER 3:00 AM WEDNESDAY.

AND WE JUST HEARD BANGS JUST BANG, BANG, BANG, BANG.

WES REER AND HIS GIRLFRIEND, SAMARA MESSER, WOKEN UP BY THE GUNFIRE RIGHT OUTSIDE THEIR BUILDING.

EARLY THIS MORNING.

HE SAYS HE HEARD THE MAN ONLY IDENTIFIED AS BEING IN HIS SIXTIES, SCREAMING AT A FEMALE PASSENGER IN HIS TRUCK.

THEN THINGS ESCALATED WHEN POLICE ARRIVED.

YEAH.

AND THE NEXT THING WE KNEW, THEY, THEY PULLED UP.

UM, AND THEN A COUPLE MINUTES LATER, HE WAS SHOOTING AT HIM.

HE WAS SHOOTING AT WHO? HE WAS SHOOTING AT THE POLICE.

FROM WHERE? FROM UNDERNEATH THE CAR OUT THERE, OR BETWEEN THE CARS OUT THERE.

GABRIEL, ON YOUR BACK.

VIDEO HERE, PROVIDED BY NEIGHBORS SHOW POLICE ARRESTING THE SUSPECT AT THE END OF THE STANDOFF MONTGOMERY COUNTY DISTRICT ATTORNEY KEVIN STEEL SAYS POLICE RECEIVED A CALL ABOUT A FAMILY MEMBER SUFFERING A MENTAL HEALTH EMERGENCY.

THE CALLER SAID THE MAN GATHERED FIREARMS AND PUT THEM IN HIS TRUCK.

POLICE SAY OFFICERS THEN ENCOUNTERED THE MAN IN THE COMPLEX PARKING LOT WHERE HE CRASHED HIS TRUCK.

THEY SAY HE GOT OUT AND FIRED AT OFFICERS WHO FIRED BACK.

THE MAN WAS TAKEN TO PAOLI HOSPITAL WITH ONE SHOT IN THE ARM, AND HE'S EXPECTED TO SURVIVE.

NO ONE ELSE WAS HURT.

REER WHILE SCARED FOR HIS FAMILY'S SAFETY.

ALSO WANTED TO HELP OFFERING UP HIS OWN APARTMENT TO SWAP MEMBERS.

AND THEN THEY WERE TRYING TO LOOK FOR PLACES TO GO TO GET A BETTER ANGLE OF WHEREVER HE WAS.

THEN I EVENTUALLY CAME DOWNSTAIRS AND I TOLD THEM, I'M LIKE, COME ON UPSTAIRS, CUZ WE HAD A, WE HAD A PERFECT LINE OF WHERE HE WAS FROM OUR WINDOW.

SO THEY EVENTUALLY CAME UP TO OUR BEDROOM AND SET UP SHOP UP THERE WITH THE, WITH THE RIFLE, HEAD OUT THE WINDOW, AND YEAH, IT'S NUTS.

THE MONTGOMERY COUNTY DISTRICT ATTORNEY IS NOW HANDLING THIS INVESTIGATION.

NO MOTIVE WAS ANNOUNCED ON WHY THIS TOOK PLACE, AND THE SUSPECT HAS NOT YET BEEN IDENTIFIED IN UPPER PROVIDENCE MARCUS ESPENOZA, FOX 29 NEWS FREE.

SO I'M GONNA SO I'M GONNA FILL IN THE BLANKS.

THE MEDIA DID NOT GET IT QUITE RIGHT, BUT I'M GONNA FILL IN SOME BLANKS WITHOUT GOING INTO TOO MUCH DETAIL.

BUT I THINK FILL IN, IN THE BLANKS REALLY PAINTS A, A PICTURE THAT I WANT TO SHARE WITH YOU OF WHAT THESE OFFICERS WENT THROUGH THAT EVENING.

SO ON MARCH 16TH, UH, AS THEY HAD MENTIONED THAT WE WERE CALLED, UM, TO THE MEADOWVIEW LANE AREA, UH, FOR A, UM, A PSYCHIATRIC EMERGENCY.

IN OTHER WORDS, UM, UH, THE WIFE HAD INDICATED THAT THE HUSBAND WAS HAVING A, A BREAKDOWN THE METAL BREAKDOWN.

UH, SHE DID MENTION THAT THE HE HAD GUNS, BUT, UM, SHE SAID HE WAS HARMLESS.

SO AS MY FIRST OFFICER, OFFICER JOHN BURSAW ARRIVED AT THE SCENE.

UH, HE GETS OUT OF HIS PATROL VEHICLE AND WITHIN NINE SECONDS OF HIM BEING OUT OF HIS CAR, UH, THE SUSPECT ENGAGED IN A GUN BATTLE WITH THE OFFICER, UM, WHILE ONLY BEING PROBABLY 10 YARDS AWAY.

UH, THE OFFICER, UM, WAS STRUCK.

UM, THE, ONE OF THE BULLETS HAD ACTUALLY SEVERED HIS POLICE RADIO COURT.

UH, SO HE WAS NOT ABLE TO CALL OUT AND NOTIFY THE REST OF THE SQUAD THAT WAS WORKING THAT EVENING, UH, OF THE, UM, WHAT HAD JUST HAD HAPPENED.

SO, UH, THE BULLET ALSO, UM,

CUT HIS SHIRT IN THE BACK AND ALSO GRAZED HIS VEST.

THE SECOND OFFICER, UM, ARRIVED ON SCENE NOT KNOWING WHAT ACTUALLY JUST HAD HAPPENED.

AND THAT OFFICER IS OFFICER MIKE SHEHAN.

AS HE WAS STILL SEATED IN HIS PATROL CAR MOVING TOWARDS WHERE THE FIRST OFFICER WAS LOCATED.

THE SUSPECT HAD GOTTEN INTO HIS TRUCK AND ACTUALLY ROUNDED THE CORNER AND ENGAGED OFFICER SHEHAN WHILE HE WAS SITTING INSIDE HIS VEHICLE.

WHAT YOU SAW WAS A SUSPECT'S VEHICLE WITH ALL THE BULLET HOLES THERE.

UH, THEY ARE BULLET HOLES THAT ARE COMING OUT OF THE TRUCK, NOT GOING INTO THE TRUCK.

UM, AND SO UNFORTUNATELY, UM, BULLETS STARTED HITTING THE, UH, THE PATROL VEHICLE.

UH, OFFICER SHEHAN WAS, UH, HAD TO WORTH ALL AND THE ABILITY TO ACTUALLY GET OUT OF THE VEHICLE, UH, ENGAGE THE SUSPECT, UH, WHICH CAUSED THE SUSPECT TO ACTUALLY CRASH INTO SEVERAL PARKED VEHICLES.

UH, THE VEHICLE REMAINED SEMI-MOBILE HAD GONE JUST A FEW FEET FORWARD.

UH, HE THEN JUMPS OUT AND CONTINUED TO ENGAGE THE OFFICERS, UH, BY FIRING ROUND AFTER ROUND AFTER ROUND.

THE CALL GOES OUT EVENTUALLY THAT AN OFFICER'S BEEN INVOLVED IN, IN THE SHOOTING AND THE CAVALRY DOES COME.

UM, AND THAT INCLUDED, UH, CORPORAL SCOTT REYNOLDS, WHO WAS ACTUALLY THE SUPERVISOR THAT EVENING, UH, AND ALSO OFFICER OCTAVIUS BAKER, WHO WAS EIGHT MONTHS ON THE JOB, MAYBE SEVEN MONTHS ON THE JOB.

UH, THEY ALL RESPONDED.

UM, AND THERE, UM, THEIR RESPONSE, THE ENTIRE SQUAD THAT EVENING, THERE WERE SQUAD TROOPS, WAS, UH, UH, AMAZING.

THEY DID SUCH A, A FANTASTIC JOB.

EVEN AFTER THE FIRST TWO OFFICERS HAD GONE THROUGH WHAT THEY HAD GONE THROUGH, THEY STILL HAD THE THOUGHT PROCESS TO RESCUE AND PROTECT THE FEMALE, THE WIFE THAT WAS STILL IN THE VEHICLE AT THE TIME THAT IT CRASHED, UM, BECAUSE SHE HAD JUMPED OUT AND RAN SCREAMING UP THE SIDE OF THE SIDEWALK, AND THEY GRABBED HER AND PROTECTED HER, NOT KNOWING WHERE THE SUSPECT WAS.

SO FOR THE NEXT, UH, HOUR OR SO, THE SUSPECT, UH, HIS LOCATION WASN'T REALLY KNOWN, ALTHOUGH HE WAS FIRING INDISCRIMINATELY.

UH, REALLY WASN'T KNOWN.

IT WAS DARK OUT.

HE WAS, UH, IN A, UH, A WOOD LINE, A LOT OF VEHICLES THAT WERE PARKED.

UH, BUT, UH, CORPORAL REYNOLDS REALLY DID A FANTASTIC JOB OF MANAGING THAT CRISIS.

AND OF COURSE, OFFICERS FROM, AS FAR AS WAYS UPPER DUBLIN ACTUALLY RESPONDED AS WELL.

OFFICERS KNOW EVERY DAY THAT THEY PUT ON A UNIFORM THAT THIS IS A POTENTIAL, IT COULD HAPPEN IN THE FIRST FIVE MINUTES OF YOUR SHIFT.

IT COULD HAPPEN IN THE LAST FIVE MINUTES OF YOUR SHIFT, BUT YET THEY STILL COME IN AND GO TO WORK AND PUT THEMSELVES IN HARM'S WAY FOR THE PEOPLE THAT THEY SERVE IN THIS COMMUNITY.

I COULDN'T BE MORE PROUD OF EACH OF THESE OFFICERS.

I'M PROUD OF MY ENTIRE DEPARTMENT.

BUT THESE FOUR OFFICERS THAT EVENING REALLY SHOWED PROFESSIONALISM, COURAGE, BRAVERY, AND, UH, THEY DESERVED TO BE RECOGNIZED HERE TODAY.

THE OFFICERS CAN COME UP.

NOW, THEY DIDN'T WANT YOU TO STAND UP HERE THE WHOLE TIME THAT I WAS TALKING, BUT COME ON UP.

I AM THE CIS, THE CRISIS INTER INTERVENTION SPECIALIST INSTRUCTOR AT MONTGOMERY COUNTY EMERGENCY SERVICE.

WE RUN THE OLDEST SCHOOL IN THE NATION TO EDUCATE LAW ENFORCEMENT ON HOW TO IDENTIFY MENTAL ILLNESS AND HOW TO INTERACT WITH IT SAFELY AND DEESCALATION AND PEOPLE IN CRISIS.

ONE THING I WOULD, I'M SO HONORED TO BE HERE BECAUSE THIS IS NOT FOR UPPER PROVIDENCE POLICE DEPARTMENT.

THIS IS NOT JUST A HUNDRED PERCENT RECOGNITION THAT THEY'VE SENT ALL THEIR OFFICERS THROUGH.

THIS IS NOT A CHECK IT OFF THE BOX TRAINING.

THESE OUTSTANDING OFFICERS, THEY HAVE DEDICATED THEMSELVES TO MAKING SURE THAT THEY DON'T JUST CA THEY DIDN'T JUST COME TO THE TRAINING.

THEY DIDN'T JUST SIT THERE AND WATCH, WELL, I DON'T DO POWERPOINTS, BUT THEY ACTUALLY ENGAGE.

SO THIS IS AN ONGOING RELATIONSHIP THAT WE HAVE DEVELOPED WITH THEM.

UM, BUT I REALLY WANT TO NOT JUST HONOR THE FACT THAT THEY SEND A HUNDRED PERCENT THROUGH, WHICH TAKES A LOT.

IT'S, UH, I THINK PEOPLE JUST THINK, OH, WE JUST SENT OUR OFFICERS TO TRAIN IT.

IT'S SO MUCH MORE THAN THAT.

IT'S A FREE TRAINING.

IT'S NOT A TRAINING THAT IS MANDATED IN THE STATE OF PENNSYLVANIA OR IN MONTGOMERY COUNTY, BUT THIS DEPARTMENT HAS DEDICATED THEMSELVES TO MAKE SURE THAT EVERY OFFICER HAS GONE THROUGH.

AND THAT IS MAKING SURE YOU KNOW, THAT THEY HAVE STAFFING ISSUES.

AND WE ALL KNOW THAT THERE IS A STA STAFFING CRISIS.

AND TO SEND 'EM, YOU KNOW, THERE'S PEOPLE THAT RETIRE, THERE'S PEOPLE THAT ARE OUT SICK.

IT TAKES A LOT TO ORGANIZE, TO GET EVERYONE THROUGH.

AND WE ALSO DO AN ADVANCED TRAINING, AND MANY OF THOSE OFFICERS HAVE COME THROUGH THAT ALSO.

BUT THE PRIDE I HAVE IN THIS DEPARTMENT, NOT JUST FOR THE OUTSTANDING OFFICERS, BECAUSE, YOU KNOW, I WOULD LOVE TO SAY I'M A GREAT INSTRUCTOR, BUT I HAD GREAT PUPILS.

YOU CAN'T TEACH THESE KIND OF SKILLS TO PEOPLE THAT HAVE NO INTEREST IN LEARNING THEM.

UM, THE LEADERSHIP, HOW THEY TAKE CARE OF THEIR OFFICERS, ESPECIALLY AFTER THIS INCIDENT.

IF WE DON'T TAKE CARE OF OUR OFFICERS, YOU'RE NOT GONNA BE ABLE TO HELP OTHER PEOPLE IN CRISIS.

AND THAT LEADER, THEIR LEADERSHIP AND THE TOWNSHIP REALLY STEPPED UP TO MAKE SURE, SURE, THAT HAPPENED.

BUT I ALSO WANNA RECOGNIZE THE FAMILY MEMBERS BECAUSE QUITE HONESTLY, OUR OFFICERS WOULD NOT BE ABLE TO DO WHAT THEY DO WITHOUT YOU ALL.

SO IT IS ACTUALLY NATIONAL LAW ENFORCEMENT

UH, AS WE KNOW, THE PARK HOUSE PROPERTY IS BEING CONSIDERED FOR DEVELOPMENT.

UH, AN APPLICATION DEVELOPMENT PLAN HAVE BEEN, UH, SUBMITTED FOR CONSIDERATION OF 1200 PLUS RESIDENTIAL HOUSING UNITS.

THERE WAS ALSO A LETTER SUBMITTED AS PART OF THE APPLICATION ASKING FOR DISCUSSION ABOUT OPEN SPACE AND PARK.

UH, I'M NOT SURE WHERE THE TOWNSHIP IS WITH THOSE DISCUSSIONS, BUT I'M HERE TO ADVOCATE THAT THE TOWNSHIP MIGHT ACQUIRE THAT THE COUNTY MIGHT ACQUIRE IT, THE STATE MIGHT ACQUIRE IT AS OPEN SPACE AND PARK.

UM, I BELIEVE WE'RE ALL AWARE THAT HISTORICALLY THIS PROPERTY WAS PUBLIC LAND OWNED BY MONTGOMERY COUNTY AND USED TO PROVIDE A HOME FOR THE INDIGENT POPULATION OF THE COUNTY.

AND OF COURSE, WE'RE ALL AWARE OF THE EXTREME PRESSURE THIS TOWNSHIP HAS BEEN UNDER FOR MANY YEARS FOR DEVELOPMENT.

ALMOST ALL THE LARGE PARCELS OF LAND, FORMER FARMS, CONTIGUOUS TO AND SURROUNDING THIS PROPERTY ARE NOW HOUSING DEVELOPMENTS IN CONSIDERATION.

I BELIEVE THAT CONSERVING THIS PROPERTY WOULD SERVE THIS COMMUNITY BEST.

FIRST AND FOREMOST, THIS PROPERTY IS CONTIGUOUS WITH THE SCHUEL RIVER, THE UPPER SCHUEL VALLEY PARK, THE LOCK 60 RECREATION AREA, AND ACROSS THE RIVER FROM THE BLACK ROCK SANCTUARY AND THE PHOENIX IRON CANAL.

POSITIVE OUTCOMES OF CONSERVING THIS PROPERTY WOULD BE LAND PROTECTION.

SAVING THIS LAND WOULD HELP US RETAIN SOME OF THE RURAL, RURAL CHARACTER OF UPPER PROVIDENCE TOWNSHIP FROM BEING TRANSFORMED BY SPRAWL DEVELOPMENT THAT IS INSET INSENSITIVE TO PASTORAL LANDSCAPE HABITAT RESTORATION AS A REFUGE FOR WILDLIFE.

ABOUT TWO-THIRDS OF THIS GROUP, 15 SPECIES HAVE EXPERIENCED POPULATION DECLINE SINCE 1971.

QUARTER OF THIS GROUP ARE TIPPING POINT SPECIES, MEANING THAT 50% OF THAT SPECIES HAVE BEEN LOST SINCE THAT TIME.

AND THEY INCLUDE, UH, THE MOUNTAIN CLOVER, SPRAGUES, PIPIT, HENLO, SPARROW, CHESTNUT, COLLARED, LONG SPUR, AND THE BABA LINK, WHICH ARE ALL ACCELERATING RATES OF DECLINE, SHOWING EXCELLING, ACCELERATING RATES OF DECLINE.

MASSES LAW MASS, MASSIVE LOSSES OF BIRDS CAN BE REVERSED TO RESTORE GRASSLANDS USING THE SUCCESSFUL NORTH AMERICAN WETLANDS CONSERVATION ACT.

AND THAT'S AN ACT THAT'S BEEN USED TO, TO RESTORE WETLANDS, WHICH HAS BROUGHT THE ONE BIRD SPECIES IN THE NATION WATER FOUL, UH, WITH AN INCREASE IN POPULATION.

UH, ANOTHER USE WOULD BE TRAILS.

UH, THE ABANDONED ROAD, WHICH BISECTS THE NORTH NORTHERN PORTION OF THIS PROPERTY HAS BEEN USED FOR MANY YEARS AS A TRAIL CONNECTOR FROM THE UPPER SCOO VALLEY PARK, THROUGH THE PARKHOUSE PROPERTY TO OLD STATE ROAD AS A PEDESTRIAN, EQUESTRIAN, AND BICYCLING TRAIL, I SEE AN OPPORTUNITY TO EXTEND THAT TRAIL ALONG HENER ROAD TO EQUESTRIAN TRAILS THAT WOULD CONNECT TO THE TOWNSHIP PROPERTY ON SPRINGER TOWN ROAD AND ALONG MINGO CREEK, A COMMUNITY FARM CREATING A CSA, ALSO KNOWN AS COMMUNITY SUPPORTED AGRICULTURE, COULD ALSO BE A BENEFIT TO ACQUIRING THIS PROPERTY.

THIS TYPE OF FARM WOULD NOT ONLY PROVIDE FRESH, FRESH PRODUCE GROWN USING SUSTAINABLE AND ORGANIC FARMING PRACTICES, ALSO KNOWN AS AGRO ECOLOGY, WHICH WAS A NEW WORD I JUST LEARNED TODAY.

HYDROLOGY AND WATER MANAGEMENT.

THE CREEK AND THE TRIBUTARIES THAT DRAIN THIS PROPERTY REACH UP UNDER 4 22 AND ABOVE MENNONITE ROAD.

THE HEADWATER STREAMS PLAY A CRITICAL ROLE IN PROVIDING CLEAN WATER TO DOWNSTREAM COMMUNITIES AND HABITATS.

ANOTHER VALUABLE OUTCOME OF PROTECTING THE WATERSHED IS ALSO TO RESTORE AND PROTECT THE SENSITIVE STREAM SIDE HABITATS AND PROVIDE VALUABLE AND ATTRACTIVE LANDSCAPES THAT SUPPORT STREAM HEALTH.

AND FINALLY, ANOTHER USE FOR THIS PROPERTY WOULD BE TO RECOGNIZE THE LANAE HAWKIN.

THAT'S THE PHYSICAL AND SPIRITUAL HOME OF THE LEIPE.

THE LEIPE HAWKIN ENCOMPASSES THE ENTIRE DELAWARE RIVER WATERSHED AND BEYOND.

THERE IS MUCH ARCHEOLOGICAL EVIDENCE AND WRITTEN HISTORY THAT A BAND OF LEIPE OCCUPIED THIS PORTION OF THE SCHUEL RIVER VALLEY.

WE'RE PROJECTING AT AROUND $12 MILLION.

UM, UM, I'M GETTING A RICHARD AND I ALWAYS HAVE A SPIRITED DISCUSSION.

IF WE THINK WE'RE HEADING INTO A, A RECESSION, WHAT IMPACT WILL THAT HAVE ON EARNED INCOME? THAT INCLUDED A $2 PER MONTH INCREASE IN THE RENTAL RATE FOR EACH HOME.

IT'S CURRENTLY $15 PER MONTH, SO WE GO UP TO 17, AND THAT WOULD BE A PASS THROUGH TOWNSHIP WOULD'VE TO SEE HOW THEY LIKE TO RECOVER THAT MONEY, IF THEY WANNA INCREASE THE RATES TO THE RESIDENTS OR LOOK AT THE BUDGET AND MAYBE THEY CAN EAT THAT MONEY.

UH, WILL THE, THE MONEY, THE REMAINING, UH, SECURITY HAS IS IN THE PROCESS OF BEING CUT.

THE BANK HAS AGREED TO RELEASE THE MONEY.

AT FIRST, I THOUGHT I HAD A FIGHT GOING THERE, BUT I DIDN'T HAVE ONE.

AND WE GOT THE MONEY RELEASED, AND WE WILL TURN IT OVER TO THE, UH, HOA.

UM, PURSUANT TO THE TERMS OF THE AGREEMENT THAT YOU WERE ALL GIVE IT A COPY OF FOR THE PACKET, THE, THE ORIGINAL CONCERN, AND, AND AT ONE, AND FOR A LONG TIME, THE STICKING POINT HERE IS THAT THE HOA HAD ITS OWN SEPARATE LIST OF DEMANDS THAT IT WANTED THE TOWNSHIP'S HELP IN FORCING TO GET DONE.

AND WE WERE ONLY INTERESTED IN THE PUBLIC IMPROVEMENTS THAT ARE IN THE DEVELOPERS' AGREEMENT.

AND THEY'VE AGREED THAT THEY WILL ONLY DO THE WORK IN THE SEQUENCE DICTATED BY BILL DIGMAN'S OFFICE, AND THAT THEY WON'T USE ANY OF THE MONEY FOR THEIR OWN OTHER THINGS THAT THEY WERE INTERESTED IN.

AND THERE WILL BE, UH, INSPECTIONS AT THE DISCRETION OF BILL'S OFFICE, AND THEY'LL, AS YOU CAN SEE IN THE AGREEMENT, THEY'LL GIVE US A MONTHLY ACCOUNTING OF WHERE THEY ARE WITH THE MONEY.

DO THEY, DO THEY HAVE ENOUGH MONEY IN THERE TO DO THOSE IMPROVEMENTS? IT, IT LOOKS LIKE IT, YES.

GOOD.

SO, UH, I GUESS I NEED A MOTION THEN TO, UH, APPROVE THE AGREEMENT THAT WAS IN OUR PACKET WITH HIGH POINT AT PROVIDENCE COMMUNITY ASSOCIATION, UH, REGARDING THE UNFINISHED PUBLIC IMPROVEMENTS IN THE DEVELOPMENT.

I MEAN, DOES THE BANK'S GONNA RELEASE ALL THE REMAINING SECURITY, SECURITY AND THEN IF THAT MONEY IS NOT ENOUGH TO FINISH THE JOB, THEY WILL BE GOING IN THE SEQUENCE THAT BILL DICTATES IN LEVEL OF IMPORTANCE.

AND THEN IF WE WERE TO THE END, THEN WE WOULD HAVE TO DECIDE WHETHER WE WERE GOING TO TRY TO FORCE THE REMAINING ISSUE OR NOT.

WE BELIEVE THERE'S A APPROXIMATELY $200,000 WORTH OF WORK, UH, THAT IS NOT DONE YET AT ALL.

UM, THE LAST A HUNDRED THOUSAND DOLLARS WAS FOR MORE REPAIRS LIKE SIDEWALK THAT'S BAWLING AND THAT TYPE OF THING.

SO, UM, OBVIOUSLY DO EVERYTHING THAT HAS NOT BEEN DONE FIRST AND THEN GO BACK AND TRY TO, UM, MAKE IT PRETTIER WHAT'S BEEN COMPLETED IN THE PAST, YOU KNOW, THAT TYPE OF, SO WE DON'T SEE A PROBLEM WITH HAVING THE DEVELOPMENT COMPLETE.

IT WOULD BE JUST THE QUALITY OF THE SIDEWALKS WOULD BE THE ISSUE THING.

RIGHT.

AND DRIVEWAY APRONS, ACTUALLY, I'LL HAVE 'EM DO THE SIDEWALKS FIRST, THE DRIVEWAY APRONS, AND THEY CAN GET IT DONE CHEAPER THAN WE CAN DO IT.

YEAH, NO, I GET THAT.

I JUST WORRY IF THEY RUN OUT AND THEN WELL, WELL, WHAT HAPPENS NOW, IT'S HOA AND TOWNSHIP TRYING TO FIGURE OUT HOW TO FINISH THE LIST, BUT THERE'S, THERE'S NO WAY WE CAN FORCE THE HOA TO COMPLETE THEM WITH MONIES FROM THE HOA.

UH, THE, OBVIOUSLY THE HOA HAS US FUNDS.

NO, WE HAVE, WE HAVE AN OBLIGATION UNDER OUR DEVELOPERS AGREEMENT WITH THE DEVELOPER TO, TO OVERSEE THE COMPLETION OF THE PUBLIC IMPROVEMENTS FOR THE BENEFIT OF ALL THE CITIZENS OF THE TOWNSHIP.

SO WE, WE CAN'T, WE CAN'T, IF THEY REACH A POINT WHERE ALL THIS MONEY RUNS OUT AND THE LIST ISN'T DONE, AND THERE'S, WE WOULD HAVE TO MAKE OUR OWN DECISION ON WHAT THE LEVEL OF IMPORTANCE OF THEM IS FROM A PUBLIC IMPROVEMENTS, PUBLIC SAFETY STANDPOINT.

IF WE WERE TO CUT IT LOOSE AND WOULDN'T REQUIRE IT TO BE DONE, THEN, THEN THEY COULD SPEND THEIR OWN MONEY TO DO IT, I SUPPOSE WOULD POINT WOULDN'T BE, WOULDN'T WE BE RESPONSIBLE FOR IT? THE, THE SECURITY IS THE, IS NOT THE ONLY OPTION THAT YOU HAVE TO FORCE THE COMPLETION OF PUBLIC IMPROVEMENTS, BUT YOU'RE TALKING ABOUT WHAT'S CALLED A, UM, SINGLE PROJECT ENTITY THAT DID THE JOB.

THERE'S, THERE ARE NO OTHER ASSETS OF THE DEVELOPER TO GO AFTER.

SO IF THE SECURITY'S NOT ENOUGH, YOU'D HAVE TO DECIDE THAT YOU WANTED TO SPEND YOUR OWN, THE TOWNSHIP GENERAL FUND ON IT, THAT THEN WE WOULD TALK ABOUT WHETHER THE HOA WANTED TO STEP IN.
