[4. Stormwater Management Fee Update]

STORMWATER MANAGEMENT FEE UPDATES, BRIAN, UH, AS THE AUTHORITY MEMBERS KNOW THE TOWNSHIPS 2022 BUDGET DID INCLUDE THE IMPLEMENTATION OF A STORMWATER MANAGEMENT FEE.

UM, ITEM A UNDER THIS SECTION OF THE AGENDA INCLUDES DAIRY TOWNSHIP WITHIN THE LAST COUPLE OF WEEKS.

UH, SEVERAL STAFF MEMBERS HAD A LENGTHY, MAYBE A TWO HOUR, UM, ZOOM MEETING WITH DAIRY STORMWATER, UH, ADMINISTRATOR, AND A NUMBER OF ISSUES CAME TO LIGHT.

UM, MOSTLY INVOLVING THE COMPLEXITIES THAT THEY ENCOUNTERED AS THEY IMPLEMENTED THE STORM WATER PROGRAM.

UM, THEY HAPPENED TO USE A 35 PAGE, UH, STORM WATER MANAGEMENT GUIDELINE DOCUMENT THAT, UM, INCLUDES ALL THE CREDIT STRUCTURE AND HOW THEY HANDLE CREDITS IN EVERY NATURE OF THE, EVERY, UM, EVERY COMPONENT OF THE PROGRAM.

UH, AND IT OPENED OUR EYES TO JUST HOW COMPLEX IT WOULD BE TO IMPLEMENT THE STORMWATER FEE AND INCLUDE THE CREDIT STRUCTURE THAT THE SUPERVISORS HAVE DESIRED TO BE IMPLEMENTED SUCH THAT, UH, YOU KNOW, RESIDENTS ARE ENCOURAGED TO REDUCE STORMWATER RUNOFF FROM THEIR PROPERTIES.

UM, SO WE'VE KIND OF TAKEN A PAUSE.

WE'RE THINKING THAT DELAYING IMPLEMENTATION OF THE FEE UNTIL THE FIRST QUARTER OF 20, 23 IS PROBABLY THE RIGHT STEP TO TAKE SO THAT WE CAN GET ALL THOSE DETAILS

IRONED OUT IN ADVANCE OF UNVEILING, THE, UH, THE ACTUAL FEE AND BILLING TO THE PUBLIC.

OKAY.

THAT'S CERTAINLY, IT MAKES SENSE TO ME BECAUSE WE WANT TO BE READY FOR ANY QUESTIONS AND CONCERNS THAT MAY BE RAISED BY THE RESIDENTS OR THE COMMENTS FROM THE BOARD MEMBERS.

OH, IT TAKES CARE OF, UH, ALL OF THE NUMBER FOUR, THEN IT GOES, RIGHT.

UH, I JUST MENTIONED UNDER THE WESTCHESTER BOROUGH AND MAYBE JOE, JOE CAN CHIME IN AND SPEAK TO WHERE THE, UH, COURT CASES THAT'S CURRENTLY PENDING.

UM, BUT I'D MENTIONED TOO THAT, UH, WESTCHESTER HAS IMPLEMENTED THE STORMWATER FEE, UH, HAS AGREED TO MEET WITH US.

I THINK WE'RE MEETING IN ABOUT TWO WEEKS WITH THE BOROUGH MANAGER, APRIL 12TH, THANK YOU TO DISCUSS, UH, THE ISSUES AND CONCERNS WITH THE WESTCHESTER HAS ENCOUNTERED IN IMPLEMENTING THE STORMWATER FEE.

THIS, THIS THE CASE IN WESTCHESTER GOES BACK TO THE DIFFERENCE THAT I SPOKE ABOUT BEFORE BETWEEN A FEE AND ATTACKS.

AND I'M SOMEWHAT REPETITIVE WITH THAT, BUT IT'S REALLY AT THE CORE OF THIS WHOLE THING.

AND YOU'LL HEAR ABOUT IT A LOT MORE IN THE, YOU KNOW, IN THE NEWS AND EVERYTHING, AS THIS MOVES FORWARD, TAX IS A MONEY RAISER.

IT'S IT'S YOU, YOU HOWEVER MUCH MONEY YOU NEED.

YOU USE A TAX TO GET THAT MONEY IN UP TO THE LIMITS OF THE TAX.

A FEE IS A REIMBURSEMENT FOR A COST THAT YOU INCUR.

AND SO HISTORICALLY MUNICIPALITY CAN CHARGE IT CAN IMPOSE TAXES.

IF YOU WANT TO DO IMPOSE A FEE FOR SAY, STORM WATER, IT HAD TO BE, YOU HAD TO FORM AN AUTHORITY TO DO IT BECAUSE AUTHORITIES UNDER THE AUTHORITIES ACT CAN IMP CHARGE FEES, BUT THERE IS NOTHING IN THE LAW FOR THE TOWNSHIPS THAT SAID THEY COULD CHARGE THE FEES.

SO A COUPLE OF YEARS AGO, THE LEGISLATURE ADOPTED A LAW THAT SAID THE SECOND CLASS TOWNSHIPS CAN CHARGE FEES FOR STORMWATER.

SOMETHING THAT PREVIOUSLY COULD ONLY BE DONE BY AN AUTHORITY.

THEY DIDN'T WANT EVERY TOWNSHIP TO HAVE TO RUN OUT AND FORM AN AUTHORITY TO, TO DO THE WORK FOR THE STORMWATER.

SO AFTER THEY HAD MS FOR STUFF CAME ALONG AND THEY SAID, LET'S MAKE IT SO THAT THE TOWNSHIPS CAN DIRECTLY CHARGE A FEE WITHOUT FORMING AN AUTHORITY.

IT WAS ACTUALLY ORIGINALLY INTRODUCED AS A BILL FOR BORROWS AND FIRST-CLASS TOWNSHIPS AS WELL.

BUT THROUGH THE POLITICAL WRANGLING PROCESS, THEY FELL AWAY.

AND ONLY THE SECOND CLASS TOWNSHIPS SURVIVED TO ENJOY THE BENEFIT OF THIS LAW AND IN FIRST-CLASS TOWNSHIPS, WHICH IS A DENSITY THING.

IF YOU'RE A MORE DENSE TOWNSHIP, USUALLY A FIRST-CLASS, IF YOU ELECT TO BE OR BURROWS, THEY STILL HAVE TO FORM AN AUTHORITY.

SO YOU HAVE A UNIQUE POWER RELATIVE TO THOSE MUNICIPALITIES.

UM, WESTCHESTER IMPOSED, A FEE THAT THE WESTCHESTER BOROUGH, THAT WESTCHESTER UNIVERSITY, AND NOW THE WHOLE STATE EDUCATION SYSTEM HAS JUMPED IN SAYING, IT'S NOT A FEE IT'S ATTACKS AND THAT YOU CAN'T JUST CALL IT A FEE IF IT'S REALLY A TAX, BECAUSE IT'S NOT, IT'S NOT DIRECTLY REIMBURSING YOU FOR COSTS RELATING TO CERTAIN THINGS.

SO IT'S A TAX THAT'S BEING CALLED A FEE.

AND THAT CASE IS PENDING NOW IN COMMONWEALTH COURT, WHICH IS ONE OF THE APPELLATE COURTS IN PENNSYLVANIA.

IT, IT DOESN'T INVOLVE SECOND-CLASS TOWNSHIPS AND THEY DON'T HAVE THE EXTRA POWER THAT YOU HAVE.

BUT IF THE CASE DECISION WAS BROAD ENOUGH, AND THEY SAID THAT ANY STORM WATER FEE IS REALLY ATTACKS, THEN I THINK IT WOULD EVEN APPLY TO YOU.

YOU KNOW, IF THEY SAY BROADLY THAT EDDY STORMWATER FEE IS A TAX, YOU'RE NOT GOING TO BE SAVED BY THE LANGUAGE THAT WAS ADOPTED FOR YOU, THAT ALLOWS YOU TO CHARGE A FEE.

IF COMMONWEALTH COURT SAYS THAT ALL FEES OR TAXES FOR STORM WATER, AND I'M NOT SAYING THEY'RE GOING TO RULE THAT WAY.

NOBODY KNOWS HOW THEY'RE GOING TO RULE THE DISTINCTION IS YOU COULD STILL BE YOU'D WOULD STILL BE OKAY IF THEY CALL IT A TAX, THEN YOU CAN IMPOSE A TAX FOR IT.

THE SUPERVISORS CAN, BUT THEN YOU WOULD HAVE EVERY, EVERY NONPROFIT WOULD BE EXEMPT.

SO WITH FEES NON-PROFITS ARE NOT EXEMPT.

EVERYBODY PAYS AND WITH A TAX THEY'RE EXEMPT.

AND IN FACT, YESTERDAY, A CITIZEN FILED A COMPLAINT.

CHELTENHAM ADOPTED THIS AS ATTACKS, AND THIS GUY IMMEDIATELY FILED A COMPLAINT WITH DEP THAT'S NOW BEING CIRCULATED AMONG ALL THE MUNICIPAL PEOPLE OUT THERE.

UM, WHERE HE'S SAYING IT'S UNFAIR.

IF IT IS, IF YOU DO HAVE TO CALL IT ATTACKS, IT PRESENTS A NEW SET OF POLITICAL CHALLENGES, BECAUSE IF YOU EXEMPT ALL THE PLACES THAT ARE EXEMPTED, HE'S ARGUING THAT THAT'S UNFAIR BECAUSE THEY'RE BENEFITING FROM SOMETHING THAT THEY'RE, THAT THEY'RE NOT HAVING TO PAY FOR.

AND IT, HIS EXACT, I HAVE HIS, HIS COMPLAINT TO DEP IT SAYS THE TOWNSHIP TAX AVOIDANCE PROVISION, UNFAIRLY EXEMPTS 14 TOWNSHIP BUILDINGS, SEVEN PUBLIC SCHOOLS,

103 MILES OF TOWNSHIP, ROADS, AND STORM SEWERS ESTIMATED AT 20 ACRES OF PARKING LOT, SEVEN UNIVERSITY CAMPUS BUILDING 5,300 UNITS THAT HAVE UNTAXED DEPARTMENTS AND A NEW 70 ACRE UNIT DEVELOPMENT AT THE ASHBURN COUNTRY CLUB.

SO THAT'S THE KIND OF THING THAT'S GOING TO ROLL OUT FROM PEOPLE, IF IT CAN ONLY BE DONE AS, AS TAX AND NOT AS A FEE THAT APPLIES TO EVERYBODY.

UM, THAT'S JUST ANOTHER REASON TO SUPPORT WHAT BRIAN SAID ABOUT, UH, UNDER THE FIRST PART ABOUT WAITING A LITTLE BIT AND MAYBE SEE HOW THIS CASE GOES TO, UM, MOST COMMONWEALTH COURT CASES ARE DECIDED IN NINE MONTHS.

THIS ONE MIGHT TAKE LONGER BECAUSE THEY'RE ACTUALLY TRYING THE CASE.

IT'S NOT AN APPEAL TO COMMONWEALTH COURT, THEY'RE ACTUALLY HEARING IT.

SO IT MIGHT TAKE A LITTLE BIT LONGER.

UM, AND I HAVE SPOKEN TO THE ATTORNEYS IN THAT CASE.

UM, IT'S, IT'S NOT DECIDED YET, AND THAT'S, IT COULD TURN OUT TO BE AN IMPORTANT DECISION.

AGAIN, IT WILL TAKE AWAY THE POWER OF THE TOWNSHIP TO DO IT, BUT IT'S THAT WHOLE TAX VERSUS FEE THING.

AND THEN IF IT IS, AND IF IT CAN ONLY BE ATTACKS AND ALL THE TAX EXEMPTS ARE EXEMPT, THEN HOW DO THE SUPERVISORS FEEL ABOUT IMPOSING IT ON EVERYBODY ELSE? SO THAT'LL BE THE DISCUSSION DOWN THE LINE.

HAVE THERE BEEN MANY QUESTIONS FROM THE PUBLIC ABOUT THIS AT ALL? OR WE THINK ANYBODY'S SORT OF GETTING THE MESSAGE YET OR NOT.

THERE WERE JUST A HANDFUL OF QUESTIONS, I THINK, AT THE LAST, UM, BOARD OF SUPERVISORS MEETING, UH, AND THEY WERE SPECIFIC TO THAT, UH, THE TABLE THAT WAS PUBLISHED, THE FEE STRUCTURE THAT WAS, UH, PUBLISHED IN THE TOWNSHIP NEWSLETTER.

UM, I KNOW THE SUPERVISORS WANTED TO GET THAT OUT IN, IN FRONT OF EVERYBODY AND, YOU KNOW, IT'S SOMETHING THAT THEY, THEY WANT FOLKS TO BE AWARE OF, WELL IN ADVANCE OF ITS IMPLEMENTATION.

SO, UH, WE DID GET A COUPLE OF QUESTIONS ABOUT IT.

IS THAT A, IS THAT EVERYTHING FROM WESTCHESTER? YES.

HEY, DO YOU WANT TO SAY ANYTHING ABOUT THE IMPERVIOUS MAP UPDATE? YOU'RE THE LAST ON AGENDA ITEM NUMBER FOUR THAT I WOULD WANT TO TOUCH ON IS THE IMPERVIOUS MAP.

UM, THE IMPERVIOUS MAP THAT WE USE TO DERIVE THE NUMBER OF SQUARE FEET OF IMPERVIOUS COVERAGE ON ANY GIVEN PROPERTY, UH, RESULTS FROM, UH, UH, FLY OVER THAT THE DELAWARE VALLEY REGIONAL PLANNING COMMISSION DID IN 2015.

UM, SO NOW IT'S 2022.

THAT DATA IS ABOUT SEVEN YEARS OLD, AND I HAVE AN INQUIRY INTO THE DVR PC TO FIND OUT IF AND WHEN, UH, THEY ANTICIPATE FUNDING THAT FLY OVER AGAIN, TO COME UP WITH A MORE ACCURATE DATA, OBVIOUSLY LIKE I'M LIKE DOING A REASSESSMENT FOR THE COUNTY FOR, FOR TAXING PURPOSES.

THE FURTHER WE GET AWAY FROM THAT DATE, WHEN THAT DATA WAS OBTAINED, THE LESS ACCURATE IT IS.

SO WE'D AT LEAST LIKE TO BE ABLE TO TELL THE BOARD AND THE AUTHORITY MEMBERS WHEN WE, WHEN, UH, DB RPC ANTICIPATES, UH, UPDATING THAT SO THAT IT CAN BE IMPLEMENTED, UM, TO REVISE THE NUMBER OF IMPERVIOUS SQUARE FEET ON EACH PROPERTY, UM, TO HELP DRIVE THE DECISION THAT WILL ULTIMATELY MADE WHAT WE RELY ON THAT EVERY FIVE OR 10 YEAR FLY OVER OR WHAT WE LOOK AT EVERY SINGLE BUILDING PERMIT APPLICATION THAT COMES IN EVERY TIME SOMEBODY WANTS TO BUILD A DECK OR WIDEN THEIR DRIVEWAY, OR PUT AN ADDITION ON THEIR HOME, OR PUT A PAVER PATIO OUT BACK AT WHAT LEVEL OF DETAIL ARE WE GOING TO END UP, UM, ADMINISTERING THIS PROGRAM.

THAT WAS ONE OF THE DETAILS THAT CAME TO LIGHT.

WHEN WE TALKED WITH A YOUNG LADY FROM DAIRY TOWNSHIP, SHE WAS REVIEWING EVERY SINGLE ZONING PERMIT BUILDING PERMIT THAT WAS ISSUED BY THE TOWNSHIP.

AND SHE SAID IT WAS FAR MORE ARDUOUS THAN THEY ORIGINALLY ANTICIPATED.

IT MIGHT BE, YEAH, THAT WOULD BE A BIG TASK.

DEFINITELY.

IT'S MUCH EASIER TO USE A IRRITABLE INFORMATION.

THE DVR PCS, I KNOW DVR PC USED TO USE, UH, YOU USED TO HAVE NEW FLYERS EVERY FIVE YEARS.

THEY DID NOT DO IT IN 2020.

UM, AND SO I'LL BE INTERESTED TO HEAR WHAT, WHAT THEIR SCHEDULE IS ALSO.

UH, IF THERE'S NOTHING ELSE ON THAT, WE'LL MOVE ON TO ITEM NUMBER FIVE, WHICH IS THE PROJECT STATUS REPORTS.

TINDI RUN SANITARY SEWER PROJECT.

THE CONTRACTOR IS 90% COMPLETE IN THE MARSH WOULD DEVELOPMENT.

THE LAST 10% WILL BE DONE WHEN THEY DO OLD STATE ROAD, WHICH WEATHER PERMITTING.

THEY SHOULD BE AN OLD STATE ROAD TOMORROW, STARTING INSTALLATION AT THE SANITARY SEWER THERE, UM, THE PUMP STATION CONTRACT, OR HE IS NOW ON SITE.

HE DID THE CLEARING AND THEY'RE DRAWING THE AREA TO TRY TO BREAK UP THE ROCK SINCE WE'RE NOT AT THE BLAST.

AND THEN THEY'RE GOING TO START IN EXCAVATE TO INSTALL THE PUMP STATION WET WELL, BUT NOW ONCE WE'RE DONE IN OLD STATE ROAD, WE'LL MOVE AND DO ROSEMONT TO DEVELOPMENT.

AND THEN THE LAST THING IS GOING TO DO WILL BE FRUIT FARM ROAD, BUT I HAVE TO CONNECT EVERYTHING TOGETHER.

THE GREENWOOD AVENUE, SANITARY SEWER EXTENSION, THE PLANNING MODULE IS BEING IS IN THE ADVERTISING STAGE, THE PUBLIC REVIEW STAGE, I BELIEVE THAT ENDS NEXT WEEK.

AND THEN THE TOWNSHIP HAS TO ADOPT THE RESOLUTION AND THEN IT CAN BE SENT TO DDP FOR APPROVAL.

IN THE MEANTIME, WE ARE IN THE PROCESS OF DOING THE PRELIMINARY DESIGN FOR THAT.

AND WE HAVE TO GET A PEN THAT PERMIT SINCE GREENWOOD AVENUE IS A PENN DOT ROAD.

SO IT WILL BE A PROCESS TO GET THE, FROM IT, BUT WE WILL GET IT EVENTUALLY.

SO IF EVERYTHING WORKS OUT BY THE TIME THE PLANNING MODULE IS APPROVED BY DP, WE SHOULD HAVE ALL THE DOCUMENTS DONE AND BE ABLE TO GET THE BID SHORTLY THEREAFTER.

THE CAROLINE DR.

CORMAN CIRCLE PROJECT THAT IS, THAT IS COMPLETE CONSTRUCTION WISE.

THE CONTRACTOR HAS LIKE THREE ITEMS LEFT ON HIS PUNCH LIST TO DO.

AND HE'S WORKING ON GETTING HIS, I TALKED TO THE CONTRACT YESTERDAY ABOUT IT.

IT WAS IN THAT EARLY AND MONDAY OF THIS WEEK TO, UM, SHOOT IN THE PROPERTY LINES AND ASK THEM, CAUSE WE'RE GONNA NEED EASEMENTS THERE TO RUN THE SEWER LINES.

WE BETWEEN THE SIDE PROPERTY LINES OF CERTAIN PROPERTIES UP THERE.

AND THEN DOWN THAT ALLEY THAT'S EXISTING AT THE TIME THAT IS THE MANHOLE IN THE SHOPPING CENTER.

AND ONCE WE GET THE SURVEY, WE'LL START WORKING ON THE EASEMENTS AND LIMITED DESIGN WITHOUT BE UNDERWAY ALSO IN SOUTH LEWIS ROAD.

I THINK TOM CAN ANSWER THAT.

YEAH, I GUESS WE'RE ALSO IN THE, UH, THE PLANNING, PLANNING MODE OF THAT.

HEARING NONE, UH, LOWER PORT VALLEY, REGIONAL SEWER AUTHORITY UPDATES.

THE CONTRACTOR THERE IS WORKING BEHIND PFIZER.

NOW HE HAS PROBABLY APPROXIMATELY 200 FEET TO COMPLETE BEHIND PFIZER.

AND THEN HE'LL BE JUMPING ACROSS THE CREEK IN THE LOWER PROVIDENCE TOWNSHIP WHERE IT HAS A COUPLE OF THOUSAND FEET TO DO.

SO I ASSUME HE'LL BE OUT OF THIS TOWNSHIP BY THE END OF APRIL AND OVER IN LOWER PROVIDENCE FOR A MONTH OR SO THERE.

AND THEN HE HAS A SECTION OF 500 FEET UP IN CULTURAL BOROUGH TO DO, AND THEN HE'S GOT TO COME BACK DOWN AND START DOING ACTIONS WHERE WE GOT TO CUT THE OLD EXISTING INTERCEPTOR TO TIE EVERYTHING TOGETHER.

SO IT'S BEEN GETTING BETTER.

HE'S BEEN GETTING MORE PIPE IN, IN ONE PIPE A DAY LATELY.

SO HE'S MOVING ALONG THE BETTER THAN HE WAS.

AND JUST MENTIONED THAT AT THE LAST MEETING, THE BOARD OF SUPERVISORS ENACTED AN ORDINANCE CREATING AN ENVIRONMENTAL ADVISORY COUNCIL.

UM, IT WAS, IT IS STRUCTURED SUCH THAT THERE WILL BE FIVE MEMBERS ON THE COUNCIL.

UM, TWO WOULD BE APPOINTED AT LARGE BY THE BOARD OF SUPERVISORS.

ONE WOULD BE FROM THE PARK AND REC BOARD, ONE FROM THE PLANNING COMMISSION AND ONE FROM THE MUNICIPAL AUTHORITY.

UH, SO IN EFFECT WERE LOOKING FOR A VOLUNTEER OR FOR THE, UM, UM, AUTHORITY MEMBERS TO ELECT ONE OF YOU TO REPRESENT THE AUTHORITY ON THAT ENVIRONMENTAL ADVISORY COUNCIL.

UM, I DON'T KNOW IF THAT ORDINANCE WAS CIRCULATED YET, UH, BUT I WILL MAKE SURE THAT IT GETS CIRCULATED TO THE AUTHORITY MEMBERS SO THAT YOU'RE AWARE OF WHAT THE EACS WILL BE TASKED WITH AND WHAT THEIR RESPONSIBILITIES AND SCOPE OF PRACTICE MAY BE.
